FEE 3� T b18._/ SC 5a.5 SEC. 402fL I soot 452 PAGE 402 THIS DEED, made this filth day of December, 1968, by and between AOELAI DE MUGHES, a widow, party of the first part, and , VIRGINIA WILLIAMS, party of the second part. WITNESSETH: That for and in consideration of the sum of $1,000.00, cash in hand paid, the receipt whereof is hereby acknowledged, the said party of the first part does hereby GRANT, BARGAIN, SELL AND CONVEY, with GENERAL WARRANTY OF TITLE and ENGLISH COVENANTS OF TITLE, unto the said VIRGINIA WILLIAMS, all that certain tract or parcel of land to Albemarle County, Virginia• situated about one mile south of Covesville, containing 35 acres, more or less, composed of four parcels as follows: 1. A tract containing 4-1/8 acres, more or less, lying near Covesville Depot on the East side of Virginia -Midland Railroad (now Southern Railroad), which was conveyed to Isaiah Johnson by J. w. Morris and E. J. Morris, his wife, by deed dated October 25. 1888, and recorded November 8, 1890, in the Clerk's Office of the Circuit Court of Albemarle County, Virginia, in D. B. 94, P• 291, being all the land Owned by the said Morris east of the Virginia -Midland Railroad, but from the operation of this conveyance the deed aforesaid expressly reserves for the said Morris family a tract of one-fourth of an acre containing a family graveyard, with the right of ingress and egress, and further reserves the right to pipe water from the spring on the said lot, provided such piping should not interfere with the purchaser's use of the said spring. 2. A small tract of one acre, more or less, lying East of the Southern Railroad and adjoining the lands of Frank Clark, Isaiah Johnson and Thomas F. Morris, which was conveyed 1 _ a -----'--.. - eou 452 PALE 403 to the said Isaiah Johnson by Frank Clark and Annie Clark, his wife, by deed dated August 23, 1900, and recorded December 3, 1900, in the Clerk's Office aforesaid in 0. B. 119, P. 63. 3. A tract of 15.9 acres lying on the East side of the Southern Railroad, adjoining Isaiah Johnson, and described by reference to a survey and plat of A. C. Rucker, dated May 10, 1900, and recorded with the Birch deed in 0. B. 118, p. 67, which tract was conveyed to the said Isaiah Johnson first by a j deed of S. A. Birch and Elizabeth W. Birch, his wife, and A. N. Peyton, a widower, dated May 21, 1900, and recorded August 25, I 1900, in the said Clerks Office in D. B. 118, p. 67. and second I by a deed of correction by the said S. A. Birch and wife and the said A. N. Peyton and F. S. Peyton, his wife, and Reading Iron Company, a corporation, and the Samuel Miller School I District Board dated July 16,.1901, and recorded February 26, i 1902, in the said Clerks Office in 0. B. 122, p. 155, but from e the operation of this conveyance the deed aforesaid expressly reserves to the said Reading Iron Company, certain mineral ; rights in the said land with the further right of its agents and employees to enter the said land at any, time for the purpose of prospecting for and mining of any minerals on the said land and i to do whatever ma be necessary for such y y prospecting and mining, which latter deed included also an additional adjoining tract of .86 acres which had previously been conveyed to the said Samuel Miller School District Board. 4. A tract containing 15,acre3, more or less, adjoining Isaiah Johnson aforesaid, which was conveyed to the ;aid Isaiah Johnson by.Robert N. Pugh and Susie E. Pugh, his wife, .2. C A BOCK. 4.2 PAGE 404 e by deed dated May 4, 1909, and recorded July 17, 1909, in the said Clerk's Office in D. B. 140, p. 201, which conveyance, however, expressly granted free ingress and egressat three specified points in consideration of a grant and quitclaim by the said Isaiah Johnson to the grantors of a 25 foot strip of land lying south of the orchard and dwelling of the said Pughs for their use as a means of ingress and egress to the Southern Railway (see deed of Isaiah Johnson and Emma Johnson, his wife, to R. N. Pugh, dated June 5, 1909, and recorded July 5, 1909, in D. S. 140, p. 165); and this deed makes the conveyance of the said tract of 15 acres, more or less, expressly subject to the restrictions and reservations expressed in the Reading Iron Company deed of November 20, 1908, which is of record in the said Clerk's Office in D. B. 139, P. 9- The said Isaiah Johnson departed this life Intestate in the year 1936 leaving as his sole heirs at law two daughters, Adelaide J. Hughes and Dora Johnson, his wife having predeceased him, the said property at that time vested in his two said daughters. The said Dora Johnson departed this life intestate, unmarried and without issue in 1950, at which time her one-half undivided interest in the said property passed to the said Adele J. Hughes under the Virginia Statute of Descents, she being her sole heir at taw. Reference to said deeds is here made for a more particular description of the property hereby conveyed.
