Critical Slopes Waivers
The request for a waiver to develop on areas of critical slopes for the plan received 6 April 2000
has been reviewed. The critical slope areas are along Lewis and Clark Drive and along the
southwestern section of this plan. Critical slopes make up 0.76 acres of the site's 6.69 acres, or
11% of the site area. The plan shows 100% of the critical slopes being disturbed, or 0.76 acres.
The disturbance is in the form of fill and Building#1 being place over the critical slopes. After
grading, newly constructed critical slopes would exist on 0.31 acres, or 4.6% of the site area.
Below, each of the concerns of section 18-4.2 is addressed by Engineering:
Rapid and/or large scale movement of soil and rock;
Proper construction of slopes will prevent movement of soil and rock.
Excessive stormwater run-off;
The stormsewer system shown on the site plan will prevent excessive runoff from, or on,
critical slopes.
Siltation of natural and man-made bodies of water;
County inspection and bonding of erosion control measures will address excessive
siltation during construction. Proper vegetative stabilization will prevent long term
siltation.
Loss of aesthetic resource;
This is a pastoral slope and grass-lined ditch located within a commercial development.
A greater travel distance of septic effluent
This site is serviced by public sewer, so septic effluent is not an issue.
Based on the review above, there are no engineering concerns which prohibit the approval of the
critical slope waiver. Please contact me if you have questions or require additional information.

Curvilinear Parking Modifications
The proposed parking configuration on the preliminary plan received on 6 April 2000 has been ,
reviewed. A Curvilinear Parking Waiver request letter was received for this plan.
The plan shows the proposed parking lot west of Lewis and Clark Drive and adjacent to the
proposed building#1 and building#2. This lot has 606 spaces. The curvilinear parking consist
of 17 spaces located within the proposed parking lot. The spaces are 9 feet wide by 16 feet long
with a 2-foot overhang. The aisles are 24 feet wide. These dimensions meet the minimum size
requirements listed in section 18-4.12.6.5 of the County Code. The minimum sight distance of
100 feet [18-4.12.6.3] is met with the proposed layout. The curvilinear parking is along a gradual
curve that is designed to conform to site conditions
Based on the review above, the Engineering Department recommends approval of the proposed

Critical Slope Disturbance Waiver Request
Dear Ms. Aanarante:
As you are aware, the above referenced project proposes to disturb areas that have been
identified as Critical Slopes. These areas are shown on the Demolition & Erosion Control
Plan (Drawing C-4). This disturbance is not currently permitted according to the County of
Albemarle Zoning Ordinance [4.2]. As a representative of the owner, The University of
Virginia Real Estate Foundation, Draper Aden Associates would like to request that a waiver
be granted allowing the disturbance of these critical slope areas. Attached is a reduced size
copy of our Demolition and Erosion Control Plan showing the proposed disturbances.
The areas of disturbance shaded on Drawing C-4 total 0.76 acres of the 6.69-acre site. Of
the 0.76 acres of critical slopes that are being disturbed, approximately 0.50 acres were
created through previous land disturbance. The previous land disturbing activities were the
construction of Lewis& Clark Drive. The new critical slope disturbance totals approximately
11% of the total site disturbance. The grading plan proposes to construct new critical slope
area totaling approximately 0.31-acres. These slopes have been created in areas where future
buildings could be constructed, which would ultimately eliminate the steep slope. The site
development plan also identifies that this slope is to receive ground cover rather than grass
cover. This will reduce the level of maintenance required for the slope and also provide a
higher level of surface slope stability. The slope that the fill material is to be placed on is an
engineered slope that was constructed with the construction of Lewis and Clark Drive.
The surface of the fill will be an impervious asphalt parking lot. The parking lot will have
a storm sewer system constructed to collect and carry the runoff to the base of the fill slope.
This construction will prevent excessive storm water runoff from impacting the integrity of
the fill slope.

Additionally, as was previously mentioned, the slope will be benched and stabilized with
natural ground cover.
The proposed erosion control measures for the grading of the site involves a sediment
basin located at the southwest corner of the site. It has been proposed to'use this sediment
basing for future construction on the site. As a result of this, the sediment basin has been
sized for managing the storm water runoff from the entire site. This means that the sediment
basin will exceed the minimum wet and dry storage volume requirements for this project.
This will provide a higher efficiency in removal of sediment from storm water runoff.
This area is currently a grass and wooded area, which has been partially disturbed from
previous land disturbing activities. The grading of the site will not diminish the aesthetic
resources of the site, as the scenic vistas and natural bodies of water are not being disturbed_
The travel distance for septic effluent does not cause concern because this site is serviced
by a public sewer system. The sewer system for the proposed building will connect to an -
existing sewer that was installed as part of the Lewis&Clark Road construction.
As has been outlined above, this construction has been designed to reduce the potential
negative impacts to the environment anti enhance the percentage of developable area within

Curvilinear Parking Waiver Request
Dear Ms. Arnarante:
As you are aware, the proposed development of this site includes the construction of
curvilinear parking spaces in the parking lot located to the north of the proposed building #1.
As a representative of the owner, The University of Virginia Real Estate Foundation, Draper
Aden Associates would like to request that a waiver be granted allowing for the construction
of curvilinear parking on this project. The curvilinear parking has been proposed at this site
to allow for the maximum level of efficiency within the parking lot. The reason for the
proposed curvilinear parking is that it allows the parking lot design to follow the curve in the
road at Lewis & Clark Drive. The curvilinear parking was appropriate both aesthetically and
from an engineering perspective.
The parking has been designed with sufficiently large radii to provide the maximum
possible sight distance within.the parking lot. These parking spaces comprise 17 of the 606
total spaces associated with this development. The curvilinear parking spaces provide a
minimum stall width of 9' and a minimum stall depth of 18'. The travel aisles through the
curvilinear parking areas are 24' in width_ These dimensions meet the requirement of
[4.12.6.3] of the County Code. The minimum sight distance outlined in [4.12.6.3] is also met
with the proposed layout.

Request to Reduce Service Space Requirement
Dear Yadira:
As you are aware, the above referenced project proposes to construct two separate
buildings on the site. At the present time, a total of 11 Load Spaces are required according to
the County of Albemarle Zoning Ordinance [4.12.7.4(b)]. Currently, 7 spaces are required
for Building #1 and 4 spaces are required for Building #2. As a representative of the owner,
The University of Virginia Real Estate Foundation, we would like to request that a waiver be
granted allowing a reduction in the total number of Loading Spaces required for this project.
We are proposing a total of 8 spaces: 4 Loading Spaces for Building #1, and 4 Loading
Spaces for Building#2.
This waiver is being requested due to the zoning and uses of the buildings that have been
proposed. The buildings are to be comprised of office and lab spaces. These uses do not
typically require a large volume of delivery and maintenance vehicles that would mandate a
higher number of service loading spaces. Please feel free to give Mr. Jeff Lighthiser or

As was discussed during our phone conversation yesterday, The Planning Department
will not be able to make a recommendation for approval of the Preliminary Site Development
Plans at the May 2nd Meeting. As a result of this, we would like to request that the Planning
Commission defer reviewing and voting on the plans until the May 16th meeting.
As we discussed, there are two reasons for the deferral request. The first reason
originates from the Department of Zoning submitting a set of review comments to your office
on the day that your staff report was due to the Planning Commission, thereby not allowing
Draper Aden Associates time to respond to the comments and resolve any issues.
The other reason for the request originates from the Department of Engineering not
receiving the waiver requests from the Planning Department in sufficient time to allow for
their review and recommendation.
As we had conveyed during our conversation, we are striving to meet a June 30e1
deadline for final site development plan approval and understand that the Planning
Department will make every effort to assist us in keeping on schedule toward this deadline.
Please feel free to give our office a call if you should have any questions or comments.
We look forward to working with you to complete the review process for this project.

Final approval from the Department of Planning and Community Development will be subject to the following
conditions: (the following conditions are those that have been identified at this time. Additional conditions may be
added or eliminated based on further review).Each comment is preceded by the applicable reference to the Zoning
Ordinance.
1. [4.12.6.2] Parking areas shall be designed to facilitate unimpeded flow of on-site traffic in circulation patterns
readily recognizable and predictable to motorists and pedestrians.Parking areas shall be arranged in a fashion to
encourage pedestrian access to buildings and to minimize internal automotive movement.
• Provide a clearly marked pedestrian walkway across the parking lot between the two buildings. The sidewalks
shown, (along the southern parking lot travelway and then to building #2), make no sense for this particular
development—please remove them.You can accomplish pedestrian access across the parking lot from building
#1 to building#2 with striping.This would not necessitate removal of any parking spaces.
• Please keep in mind that pedestrian access should be convenient and easily identifiable.
2. [32.3.8]No change,revision or erasure shall be made on any preliminary or final site plan nor on any
accompanying data sheet unless authorization for such change is granted in writing by the agent, except when
such change has been required by the site review committee or the commission. Any site plan may be revised,
provided that a request for such revision shall be submitted and processed in the same manner as the original
site plan.
The foregoing notwithstanding, the agent may approve administratively, without submission to the site review
committee or the commission,minor changes to an approved site plan in any case in which he shall determine that
the site plan,as amended, is in compliance with the terms of all applicable law; is substantially in compliance with
the approved site plan together with all conditions imposed by the commission or agent and will have no additional
adverse impact on adjacent properties or public facilities.
• This site plan shows changes to the PRA parking lot. These changes constitute an amendment to the original
PRA site plan and must be submitted as such.

The Albemarle County Department of Building Code and Zoning Services will approve
the preliminary plan for zoning compliance when the following items have been
satisfactorily addressed. The Building Official may provide separate comments. [Each
comment is preceded by the applicable reference, which is to the Zoning Ordinance
unless otherwise specified.]
1. [4.2, 4.2.3.2] Show the limits of the areas of slope that are 25% or more. Please be
6/ aware that earth disturbing activity within these areas will require a waiver from the
Planning Commission.
2. [4.12.6.5 c] Curvilinear parking requires the approval of the Planning Commission.
T3. [4.12.7.4 b] Loading spaces for offices are required on the basis of 1 space per
8,000 square feet of net office space. Building #1 requires 7 rather than 6 spaces
based on 56,000 / 8,000 = 7. The parking statistics must be revised accordingly.
Be aware the Planning Commission may reduce the required number of loading
spaces based on the criteria contained in 4.12.7.6.

VDOT and the Albemarle County Service Authority both indicated that the dedication of
the Phase I infrastructure has not been completed for North Fork. The Service Authority is
making the completion of the dedication a requirement for approval of the two sets of plans
that we have submitted (SDP 00-024, 025). If the dedication is not completed, it could
impact the internal deadlines that we have set for obtaining site plan approval.
VDOT has also indicated that there is a sight distance problem that has been caused by the
landscaping of the median. Bob Ball indicated that he and Jim Kesterson would gladly meet
us on site to identify the area of concern and requirements for modification. I can arrange the
meeting if you let me know your availability.

1. The proposed sediment basin only works for the initial clearing phase. Once they initiate..SEk'645A

At the northeast corner of Building 1 look at their proposed loading spaces and dumpster.
First, the loading spaces don't work at all. Second,the loading spaces block access to the
dumpster. Third, even if the dumpster is in a fence, they put it in the front yard along
Lewis and Clark Drive. Fourth, the cover sheet indicates there are 6 spaces,but I count 4

The Albemarle County Department of Planning and Community Development will approve the preliminary plan
referenced above when the following items have been satisfactorily addressed: [Each comment is preceded by the
applicable reference.]
1. [4.12.6.2] Parking areas shall be designed to facilitate unimpeded flow of on-site traffic in circulation patterns
readily recognizable and predictable to motorists and pedestrians. Parking areas shall be arranged in a fashion to
encourage pedestrian access to buildings and to minimize internal automotive movement.
• Provide a clearly marked pedestrian walkway across the parking lot between the two buildings.
• Show inter-parcel pedestrian connections
2. [26.4..1] Floor area ratio.Maximum total floor area permissible for individual lots shall not exceed 0 70 times the
land area of the lot.
• The Floor Area Ratio calculations on the cover sheet appear to be based on the building footprint rather than the
gross floor area. Please correct.
3 [26.10.3] Buffer zone adjacent to residential and rural areas districts: No construction activity including grading
or clearing of vegetation shall occur closer than thirty(30)feet to any residential or rural areas district. Screening
shall be provided as required in section 32.7.9
• Please show and label method of proposed screening.
• On sheet C5 please change the `buffer text' adjacent to the residential areas to state "30' buffer—no grading or
clearing of vegetation allowed without Planning Commission approval."
• On sheet C4, adjacent to the residential area, please revise the limits of clearing to 30' away from the parcel
boundary

2. The area enclosing building#2 is labeled "PHASE 1"along its eastern boundary and labeled "PHASE

3 Please show any retaining walls that may exist. Retaining walls 5-feet or taller will require and
Engineers seal and signature. [Policy]

RE: North Fork District#2, Building 1 & 2, preliminary site plan
These comments are more of an advisory than a requirement for the preliminary plan, but should
be addressed on the final plan.
1. The proposed sediment basin only works for the initial clearing phase. Once they initiate
the proposed grading, the diversion dikes will be filled and perimeter control has been
lost. Also, the grading shown on sheet c-6 indicates about 2/3 of the sediment basin area
will be filled to construct the entrance road for this site. shown grading for existing PRA
parking lot indicates some additional areas will drain to sediment basin. This means
sediment basin drainage area should account for this area.
2. 2:1 slopes (horizontal:vertical) are not acceptable as mowed areas. Per the Virginia
Erosion and Sediment Control Handbook, mowed slopes must be 3:1 or flatter. If the
slope is not to be mowed, the applicant will be required to indicate the areas to receive
groundcovers instead of grass as part of the Erosion and Sediment Control Plan.
3. The diversion dike"DD"shown on the northern perimeter should actually be a diversion
"DV" . This is not critical because the shown diversion doesn't work during
construction. The grading on sheet C-6 clearly shows this area will be regraded,
preventing this diversion from ever working.
4. There is no provision for control sediment with the proposed storm sewer. The storm
sewer is not shown on the erosion control plan and there is no mention of providing inlet
protection.
5. As this road is now in the State highway system, it is doubtful they can place inlet
protection across the existing inlets along Lewis and Clark Drive as proposed. Sediment
control must be provided on site.
6. The construction entrance must be 12' x 70' paved wash rack with water supplied from a
1"meter and 1" tap connected to a 1 %z"hose with a 1"nozzle. Construction entrance
must also have a sediment trap for the washed sediment.
7. The proposed storm sewer in the northwest corner of this site does not discharge into an
existing drainage way. They will need to provide channel calculations demonstrating the •
adequacy of the proposed channel,with respect to both capacity and velocity.
8. The drainage area for the topsoil stockpile exceeds that allowed for use of silt fence.
They will need to provide other means of sediment control, possibly a sediment trap or
basin.
9 The,engineer will need to demonstrate the adequacy of the channel for the storm sewer
discharges with respect to both flow and erosive velocities where this water enters the
existing stream.

10. The storm sewer e northeast corner of Building 1 can' .aply discharge onto the
ground next to Lewis and Clark Drive. This is a curb and gutter street with a sidewalk
between the discharge and the street. The storm sewer must connect to the existing storm
sewer.

5. [4.12.6.6.1] Parking for office use is based on 1 space per 200 square feet of net

6. [4.12.7.4] Show the loading spaces dimensioned at a minimum of 12' x 25'.
7. [4.12.7.4 b] Loading spaces for offices are required on the basis of 1 space per

Be aware the Planning Commission may reduce the required number of loading
spaces based on the criteria contained in 4.12.7.6.
8. [32.5.6 b] I count 443 parking spaces serving Building #1 and 180 spaces serving
Building #2. Please review these figures and correct the parking provided and the
total buildout statistics accordingly.
9. [26.10.1] Please show a 10' building and 10' parking setback from Lewis and Clark
Drive.
10.[ZMA 95-04] Show the buffer and Open Space as it was shown on Parcel B-8 on the
Application Plan.
11.[ZMA 95-04] Proffer 3.1. In order to keep track of all the elements contained in 3.1,
add the following elements to the total buildout schedule.
• Include MicroAire and Motion Control.
• Identify the square footage constructed per year beginning on June 12, 1996.
• Based on the requirement that construction could not exceed 500,000 sf in the
initial year and shall not exceed 200,000 sf plus undeveloped square footage,
begin to tally the square footage that could be constructed now.
12.[ZMA 95-04] Proffer 4.4 Note on the plan, No single user will require more than
125,000 gallons per day (average daily consumption) of potable water without
obtaining County approval.
13.[4.17.4] Note on the plan, "Each outdoor luminaire equipped with a lamp which emits
