SUB202100065 Brookhill Blocks 16 & 17 Easement Plat
Dear Cameron,
We received your comments regarding the project above dated May 3, 2021 and offer the following
responses:
1. [General Comment] On Sheets V4 and V7, there is a vacation line symbol shown on the parcel lines
between the Greenway Parcel and TMP 46-19138. Please verify if this was an error or intentional; it is
staff s understanding that this plat is only an easement plat and no boundary line changes are proposed.
Response: The lines shown are not vacation lines, rather land hooks to indicate that TMP 46-1988 is
non-contiguous and is located on both sides of the Greenway parcel.
2. [General Comment] Please be aware that TMP 46-18A, 46-19136, 46-19B7, 46-19138 are subject to
another plat that was approved on March 30, 2021, SUB202000189 that is creating the new greenway
parcel. That plat will likely be recorded prior to approval of SUB202100065. Please address the
following:
a. [14-302 (A)(11)] On all applicable sheets, update parcel labels so they state the correct TMP
numbers and recorded instruments. Remove references to SUB202000189 from the parcel labels
on all applicable sheets. Response: Labels have been updated
i. Please be aware that it is possible that the TMP number for TMP 46-19137 may change
after recordation of SUB202000189. Update the plat as necessary. Response: Confirmed that TMP
remained the same.
b. [14-302 (A)(15)] Update the greenway parcel note on Sheet VI so that it states the owner name
and sources of title for all TMPs affected by this plat. Response: Updated.
c. [14-302 (B)(5)] Provide a zoning note on Sheet VI that states all applicable zoning district
information for the greenway parcel. Response: Note updated to include zoning information for TMP
46-1988.
d. [14-303 (A)] Update the statement of consent to division for the greenway parcel on Sheet VI so
that it states the TMP number.
Response: Updated.
3. [General Comment] Please be aware that there is a subdivision plat currently under review that is
proposing to create/subdivide the Block 16 & 17 parcel. This application number is SUB202000228. That
plat will likely be recorded prior to approval of SUB202100065. Please address the following:
a. [14-302 (A)(11)] On all applicable sheets, update parcel labels so they state the correct TMP
numbers and recorded instruments. Remove references to SUB202000228 from the parcel
labels on all applicable sheets.

b. [14-302 (A)(15)] Update the Blocks 16 & 17 note on Sheet VI so that it states the owner name
and sources of title for all TMPs affected by this plat.
Response: Note updated.
c. [14-302 (B)(5)] Provide a zoning note on Sheet VI that states all applicable zoning district
information for the Blocks 16 & 17 parcel.
Response: Zoning notes added for TMP 46-19BB.
d. [14-303 (A)] Update the statement of consent to division for the Blocks 16 & 17 parcel on Sheet
VI so that it states the TMP number.
Response: Updated.
4. [14-302 (A)(3)] The street right-of-ways for internal streets within blocks 16 & 17 are shown on this
plat and labeled with their proposed road names.
a. Please revise Note 8 on Sheet VI so that it states "Future public right-of-ways shown hereon shall
be dedicated to public use through a separate subdivision plat to be reviewed and approved by
Albemarle County. Right-of-ways are shown on this plat for reference purposes only."
Response: Note added.
b. Please see attached VDOT comments below for further information.
5. [14-302 (A)(4)] Please update note 10 so that it references the recorded HOA covenants for Brookhill.
The HOA covenants covered maintenance and ownership responsibilities for private easements
throughout the project. Initial HOA covenants were recorded in DB 5259, page 669, DB 5366 page 528,
and amended with SUB202000043. Staff does not have the recorded instrument number for the amended
covenants that were recorded with SUB202000043. Please state the recorded instrument for those
amended covenants in the note.
Response: Note updated. I have confirmed that no additional covenants have been recorded since DB
5366 pg 528.
6. [14-302 (A)(5)] Please see Engineering comment #4. Per the Code of Development of
ZMA201500007, no SWM easements or E&S measures within the limits of the greenway. There is a
SWM easement shown within the greenway on this plat. Please revise the plat so SWM
easements/facilities are not located within the greenway.
Response: Easements are shown based on the latest road plan (SUB202100026). See sheet 11.
7. [14-302 (A)(5)] All public drainage and SWM easements will need a deed of dedication. Staff with the
Engineering Division will draft these deed templates once the plat is resubmitted to address comments for
revisions needed to the actual plat. The templates will be returned to you during a future review once this
plat is re -submitted. See Engineering Division comment #2 for further information.
Response: Noted.
8. [14-302 (A)(11) and 14-302 (A)(6)] Please revise the plat so that it clearly explains that the private
residential lots and open space lots within Block 16 and 17 are not being subdivided at this time, and their
lot boundaries are shown solely for reference purposes.
Response: Note added (#14).
9. [14-302 (A)(11)] On all applicable sheets, please update parcel labels so that they state the most recent
recorded instrument number for each parcel.
Response: Updated labels.
10. [14-303 (D)] Please state the TMP and acreage of each parcel affected by this plat. This can be a note
on Sheet VI or it can be stated in the parcel labels on Sheets V2-V7.
Response: Areas added to note 18 on sheet V3.
11. [14-312 (A)(3)] Please see attached VDOT comment #5 and Engineering comments. Road plans must
be approved prior to final plat approval.

Engineering Comments
1. WP0202100007 must be approved before subdivision can be approved.
Response: Noted.
2. Road Plan SUB202100026 must be approved before subdivision can be approved.
Response: Noted.
3. SWM facility and drainage easements will need associated deeds. The county will
provide these when the plat is ready for final signatures. Please do not provide any deeds.
Response: Noted. Please provide when ready.
4. Per the code of development, section 2.4.1 (page 18), there shall be no E&S or SWM in
the Greenway. There is a SWM easement shown in the Geenway on this plat.
Response: Easements are shown based on the latest road plan (SUB202300026). See sheet 11.
5. Retaining walls that cross lot lines will need to be in an easement and have a maintenance
agreement. The WPO and road plan showed walls crossing lot lines, but there does not
appear to be an easement on this plat. Please ensure it is shown if necessary.
Response: Wall maintenance easements have been added.
6. Please show the preserved slopes.
Response: Slopes added.
VDOT Comments:
1. The existing R/W along Polo Grounds Road does not appear to match the road plans.
Please verify the Polo Grounds R/W line and provide a deed book reference for the difference.
Response: R/W shown per right of way dedication in DB 5580, page 425. DB/pg added to road name
for reference.
2. Please include a note stating that VDOT will only maintain within drainage easements to
the extent necessary to protect the roadway from flooding or damage.
Response: Note added.
3. Please include a note stating the homeowners association is responsible for Landscaping
plants and trees adjacent to the sight distance triangle need to be maintained in an area
between 2 and 7 feet above ground as a clear zone to preserve sight lines and accommodate
pedestrians.
Response: Note added.
4. Please show proposed public R/W on all roads. Appears Marcella Street and Marcella
Court do not have proposed R/W widths.
Response: Roads have been labeled as "Future" since they are not being created with this plat, rather
just being shown for context and for ease of tying easements. See note 8 on sheet V1. Labels added to
Marcella Street and Marcella Court.
5. Approved road plans meeting SSAR, and in compliance with the VDOT Road Design
Manual are required prior to plat approval.
Response: Noted.
