In dre meantirne, on February 4, without objection by either party, the B7-A voted to reverse ils decision of October l, 2019, leaving the question of what to do with the County's pending Petition. If thc Court finds that the B-ZA rctaincd .jurisdiction o{'its October [, 2019 dccision, cvcn while thc County's Petition was pending with this Court, the Counf would request a Court Ordcr (a) rccognizing the BZA's continuing jurisdiction on Felrruary 4, 2020, and (b) contirming thc B7.A's tcvcrsal. II, however, the B7-A lost .jurisdiction once its earlicr dccision was appcalcd, this Court would necd to rulc on the County's appeal. Iiither way, a Court Order is needed to bring finality to the County's Petition. Ilecause dre County's Pet.ition before this Court doe s not "bclong" to either Mr. Maus or thc BZA, neither can tcrminate the County's Pe tition on its own. As noted in the County's Pet.ition, this case is the County's appcal of zrr October 1, 2019 dccision of'the Boiurl of Zoning Appeals (llZA). I bclicve that it both lairly reflects the uncontested lacts of this case and sugests a disposition consistent wit1r the IJ7-A's actions ol' Februa-ry 4 (to rvhich neither party objected). Llnlbrtunately, Mr. Maus dcclinod either (o endorse my proposcd Consent Order or to su&{est alternatc language, I'rn not clear on the re:rson(s) for his objection. I continue to think that the proposed Consent Ordcr would reflect a f,rir and efficicnt disposition. I'd ask that t-he Court enter this or a sirnilar Order, as only this Court can do, I'd be happy Lo answer any que stions that might aid the Court's decision.
