LZC2011-009, Blue Ridge Shopping Center, 540-550 Radford Lane (along Route 250, Rockfish Gap Turnpike) Tax Map and Parcel Number 05600-00-00-11000 (the "Property") Dear Ms Boyers: In response to your request concerning the above referenced parcel's compliance with applicable codes, regulations and ordinances, please be advised as follows. • The Property is zoned Highway Commercial (HC) under the zoning ordinance of the County of Albemarle. The HC district permits intensive retail uses to include food and grocery stores and banks by right. The Property is located in the Entrance Corridor Overlay District (EC) and is subject to the rules and regulations regarding this district. • As of this date, this Property is not the subject of any zoning amendments and is not subject to such proffers that would have been imposed on the Property • The Property is the subject of an approved site plan, SDP1996-133, amended March 5, 2004, May 7, 2008, March 16, 2009, March 20, 2009 and June 12, 2009 which allowed the development of a 56,033 sq.ft. shopping center served by 249 parking spaces and the addition of a bank with 11 required parking spaces for a total parking requirement of 260 on-site spaces. A special use permit was approved February 11, 2009 for the two drive-thru windows/lanes at the bank. \\Cob-dtsOl\CityViewLnk\Docs\2011\LZC\LZC201100009 Blue Ridge Investors,LLC.doc Ms. Jamie Boyers March 22, 2011 Page 2 ■ It must be noted that the Property currently contains 254 parking spaces, which is actually 6 short of the requirement. It appears that the notations on the site plan sheet SP1 do not coincide with the actual number of spaces shown on sheet SP2 (or those actually on site). Upon inspection of the site on March 18, 2011 the 254 spaces on-site was confirmed However it does appear that not all parking is being routinely used. This discrepancy could be resolved by applying for a parking modification for approval of the 254 spaces ■ The Property is in compliance with all other applicable zoning ordinances, rules and regulations, based on final zoning inspection(s) This letter may be relied upon by the addressee(s) listed above and by any assignee or successor in interest of the addressee(s) listed above, and by any other person who has a current or future interest in the property whether as owner or mortgagee I am authorized and empowered to execute this Zoning Compliance Letter on behalf of the County of Albemarle.
