II LLC, a Virginia limited liability company (the "Property")
Dear Mr. Raney:
In response to the recent request for a letter of compliance with zoning requirements regarding
the above -referenced Property, please be advised of the following:
The Property is situated on a parcel of land lying in the County of Albemarle,
Virginia, consisting of 3.438 acres, more or less, being comprised of and shown
as "Additional Land 2", containing 0.282 acre, more or less, "Additional Land 3",
containing 2.295 acres, more or less, and "Additional Land 5", containing 0.861
acre, more or less, on a plat by Commonwealth Land Surveying, LLC, dated
September 5, 2007 and recorded in the Clerk's Office of the Circuit Court of the
County of Albemarle, Virginia, in Deed Book 3493, pages 288 and 289.
2. The Property is zoned Commercial Office (CO) on the County's official zoning
map and code, and all regulations promulgated thereunder (collectively, the
"Zoning Code"). As of the date of this letter, the proposed use of the Property for
the construction and development of condominium dwelling units ("Proposed
Use") is among the uses permitted by right within the Commercial Office (CO)
zoning designation.
The Property and Proposed Use does not violate any existing Zoning Code in
effect on the date hereof.
4. All requirements of the Zoning Code related to ingress and egress to and from the
Property to a public street have been satisfied. The Property enjoys access onto
U.S. Route 250.
5. The County has not approved any applications for rezoning of the Property.

6. The County has approved the following special use permits applicable to the
Property: SP-02-023 White Gables.
7. The County has approved the following site plan applicable to the Property: SDP-
2003-00034.
8. There are no proffered conditions applicable to or enforceable against the
Property that would prevent use of the Property for the Proposed Use.
9. There are no special conditions or time constraints applicable to or imposed on
the Property for the Proposed Use.
10. There are no proceedings, pending or threatened, to revoke, rescind, alter, or
declare invalid any laws, ordinances, codes, approvals, permits or certificates
applicable to or issued in connection with the Property by the County of
Albemarle, Virginia.
11. There are not any outstanding parking, zoning or code enforcement issues
affecting the Property, nor any such matters previously affecting the Property.
