Way; last rev date 08-04-21
The County of Albemarle Planning Division will grant or recommend approval of the Final Plat
referenced above once the following comments have been addressed: [Each comment is
preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless
otherwise specified.]
Planning Comments (Tori Kanellopoulos)
1. NEW 18[ 4.2.21 Please remove "proposed building site" label from Sheet 2 on TMP 97-
22C0. This plat does not review or grant approval of a specific building site. Building site
review will be done with a building permit application.
2. 4-202.1(13)] The application will be reviewed as an amended plat for a revised right of
way. There is no fee for this application.
3. [14-212(C)] [14-316] Entrance approval. The revised entrance off of SR 698
(Hungrytown Road) must be reviewed and approved by VDOT.
a. REV 1: Addressed.
4. [14-302(A)(9)] Building site. Include the required building site note: Parcels 97-21, 97-
21B, 97-22B, and 97-22C each contain a building site that complies with section 4.2.1 of
the Albemarle County Zoning Ordinance.
a. REV 1: Partially addressed. Revise note to include 97-22B (22C is included
twice).
5. [14-302(A)(10)] Development rights. Provide the development rights for each parcel.
a. REV 1: Partially addressed. Revise note for 97-21 B to remove "may not be
further divided". Parcel is 122.13 acres and could be theoretically divided into
parcels 21 acres or larger without using development rights.
6. [14-3UZ(A)(15)J t94-303(U)j Uwnersnip and signature wocKs. According to C�IJ, I NIF
97-22B is owned by Margaret C. Mehring Kalton and Anna Katherine Kalton. Include
signature blocks for all owners. Additionally, there is no signature block for Walter H.
Mehring.
7. [14-302(B)(1)] Date. For the plat resubmittal, please include a 'last revised' date.
a. REV 1: Update accordingly with next resubmittal.
8. [14-302(B)(7)] Ag/Forest Districts. Both TMP 97-21 B and 97-22B are located in an
Agricultural -Forest District (Chalk Mountain).
a. REV 1: Partially addressed. Note 7 still indicates that no parcels are in an
Ag/Forest District. Also, Note 10 should be TMP 97-21 B, not 21.
9. [14-3C_ �a district. Setbacks
are as follows per Zoning Ordinance section 18-10:

10. [14-302(B)(10)] Stream buffers. Show the locations of the stream buffers on these
properties and include the required note: "The stream buffer(s) shown hereon shall be
managed in accordance with the Albemarle County Water Protection Ordinance."

11. [14-303(E)] Easements. Label the relocated right of way as private street easement'.

12. [14-303(N)] Private streets. Include the required private street note: "The streets in this
subdivision may not meet the standards for acceptance into the secondary system of
state highways and will not be maintained by the Virginia Department of Transportation
or the County of Albemarle. "

13. [14-303(Q)] Publiciprivate water. Include the following note: "Undercurrent county
policy, public water and/or sewer service will not be available to these properties."

15. Advisory comment [14-317] Private street maintenance agreement. Private street
maintenance agreements are recommended for all private streets; however, they are not
required for private streets for family subdivisions. If the applicant would prefer to pursue
a private street maintenance agreement, staff will send the checklist and template and
additional instructions.
