This approval shall be valid for a period of five (5) years from the date of this letter, provided that the developer submits a final site plan for all or a portion of the site within one (1) year after the date of this letter as provided in Section 32.4.3.1 of Chapter 18 of the County of Albemarle, and thereafter diligently pursues approval of the final site plan. In accordance with Chapter 18 Section 32.4.2.8, Early or Mass Grading may be permitted after the following approvals are received: 1. Engineering approval of a VSMP plan meeting the requirements of Chapter 17 of the Code of the County of Albemarle. The final site plan will not be considered to have been officially submitted until the following items are received: 1. Afinal site plan that satisfies all of the requirements of section 32.6 of Chapter 18 of the Code. 2. Applicable fee. See Sec.35.1. Please submit digital copies of the final site plan as well as two (2) paper copies to the Community Development Department. The assigned Lead Reviewer will then distribute the plans to all reviewing agencies. Once you receive the first set of comments on the final site plan, please work with each reviewer individually to satisfy their requirements. [32.5.2(b)] The initial site plan is hereby approved for a maximum of 132 dwelling units, unless adequate density calculations are provided by the applicant to demonstrate that a higher unit density development is permissible under the Zoning Ordinance. 2. [Comment] Greenway. The Greenway note on Sheet 3 indicates that the proposed Greenway will be platted with Phase 11 of Development. Phase 11 is nearing approval and did not include this portion of the Greenway. Review and revise appropriately. 3. [32.5.2(n)] Sidewalk materials. Identify the surface material of the pedestrian paths within Open Space Band Open Space C. Be advised, the path should be surfaced with concrete, similar to intersecting sidewalks, as these pathways are segments within the primary pedestrian path system for the development. 4. [32.5.2(a)] Zoning. Include in the Zoning notes that TMP 56A2-01-62 is located in the Entrance Corridor. 5. [32.5.2(a), 32.5.2(d)] Managed steep slopes. Albemarle County GIS data shows managed slopes located along the northern property boundary of TMP 56-57D. While a label was provided, locate the limits of managed steep slopes areas on the property. 6. [32.5.2(r)] Legend. On Sheet 3, the Legend symbol for the "Limits of the Urban Density Residential Area" appears to be missing. This could be a file error. 7. [32.5.2(b)] Recreation. The Cover Sheet notes that active and passive recreation areas are shown on Sheet 3. However, Sheet 3 did not comprehensively identify all of recreational spaces and associated amenities that are required by Section 4.16 of the Zoning Ordinance. Recreational amenities and details do not need to be shown with initial site plans but please update the note accordingly prior to the submission of a final site plan. 8. [32.5.2(i)] Emergency access. A label on Sheet 5 indicates a detail for the Emergency Access and Bicycle/Pedestrian Access Roadway is provided on Sheet 8. This detail did not appear to be included or, at least, labeled. Review and revise accordingly. The design standard for this improvement should align with the maintenance agreement that was recorded in DB 5420 PG 586. 9. [Comment] Affordable Housing. Be advised, any affordable units that are required to be affordable to achieve the density bonus are subject to the requirements of Section 16.4.3. Review of the road plan may generate additional comments on the final site plan. 11. [Comment] Landscaping. Proposed landscaping improvements, including street trees, will be reviewed with the final site plan and road plan. 12. [Comment] Retaining wall. Is a retaining wall still proposed with the development? It did not appear one was provided on Sheet 5, as indicated bya note on the Cover Sheet. If a retaining wall is provided and it crosses more than one property line, a retaining wall easement will be needed prior to final site plan approval. Variation to Location of Street Trees alone Proposed Private Street The applicant requests a variation to the location of street trees required by Sec. 32.7.9.5. Avariation to this requirement is allowed under 32.3.5(b), at the consideration of the agent. Per the applicant's letter of request, the applicant states that the request is being made "to allow the street trees to be planted within the proposed planting strips adjacent to the proposed sidewalk and along the property lines creating the separation between public amenity space and the private front yards of the lots." The requested variation to the location of street trees is approved subject to conditions. Staff has reviewed the requirements of Sections 32.7.8.5 and 32.3.5(b) and finds that the applicant's proposal is of comparable quality to the requirements of the ordinance and is consistent with the design permitted in the Neighborhood Model District which is a district promoted by the County. This waiver is approved subject to the following condition: 1. Street trees along Lots 56-65 and Lots 86-97, as shown on the initial site plan titled "Glenbrook at Foothills -Phase III, Initial Site Plan & Preliminary Plat," prepared by Collins Engineering, last revised May 20, 2021 maybe located adjacent to the street or provided at the rear of the lots, adjacent to the sidewalk. Plantings shall meet the requirements of Section 32.7.9.5. Based on the plans, I cannot determine exactly which lots are villas or townhouses. Notes indicate max. height for villas is 25 ft and SFD is 30 ft. -Fire access roads to villas and sfd require an unobstructed travel way width of 20 ft. and it appears the roads shown are appropriate for these types of homes. b. Townhomes and the multi -family home notes indicate a max height of 35 ft for both. This requires the fire apparatus access roads provide a 26 ft wide travel way. Current plans do not provide this width with the parking proposed for the apartments, which I assume is the multi -family. The roads in front of townhomes and the multi -family must provide 26 ft wide travel way width unobstructed. 2. Fire suppression, fire alerting systems and other building design features, such as exits, interior finishes, building access etc., are the purview of the building official and required as directed by that office, in conjunction with the fire marshal office. If fire suppression systems (sprinkler or standpipes) are installed the FDC must face the road, on address side and there needs to be hydrant within 100 ft. of the FDC, arranged so that when hydrant and FDC are in use for emergency operations, hose does not obstruct travel way. 3. Several areas show widths where parking is restricted entirely or on one side due to the limiting factor based on the required travel way width. In these areas, no parking markings/signs are required to prevent obstruction of the travel way by parked vehicles. Annotation on Sheet 5 ("Site Plan") states "Variable width greenway easement to be platted with the Phase I I I Development." Therefore, the County hereby respectfully demands dedication of all greenway easement areas in Phase II and Phase III that have not yet been dedicated. "No proposed name shall be a homophone or homograph of an official road name or may be easily confused with an official road name (e.g., "Forrestview" and "Forestvue" are homophones and "bow" in "Bow and Curtsie Ln" and "Bow Tie" Dr" is a homograph). This site will require a one (1) new private road name. Per Sec. 7-200-B of the County's Road Naming and Property Numbering Ordinance (Page 2 of PDF). "It is intended by this article that all roads within the County which serve or are designed to serve three or more addressable structures will be named; and that all addressable structures within the County will be assigned property numbers. Please provide stop signs for all stop locations. 2. Leeham Street Radii does not meet the minimum 200' radii. Please adjust the curvature of Leeham St. to meet the required geometry for 25 mph roadway, per RDM Appendix B(1). 3. Commercial entrance spacing must be 200' for all entrances. Proposed private streets do not appear to meet this spacing requirement per RDM B(1)-22 E.2. 4. Approved road plans meeting SSAR, and in compliance with the VDOT Road Design Manual are required prior to final plat approval. 5. Landscaping plants and trees adjacent to the sight distance triangle will need to be maintained in area between 2 and 7 feet above ground as a clear zone to preserve sight lines and accommodate pedestrians. 6. Please include a note stating that VDOT will only maintain within drainage easements to the extent necessary to protect the roadway from flooding or damage. 7. Sight lines will be required from all intersections including private streets and commercial entrances. 8. Please remove all parking spaces within the sight triangles. 9. Water lines will be in centerline of road, not in wheel path. Water lines should be moved out of asphalt area if possible. 16. Stubouts must be signed per the SSAR concerning potential/eventual street extension. 17. Please show where/how Park Ridge Drive connects to existing road on both ends of proposed road. 18. Plan sheets have too many layering issues for a complete review. 19. Note that the final plan must show conformance with the VDOT Road Design Manual Appendices B(1) and F, as well as any other applicable standards, regulations or other requirements. 20.
