The applicant held one community meeting with the Village of Rivanna Community Advisory Committee on June 24, 2019. The application was discussed at a worksession with the Planning Commission on July 30, 2019. This application has been considered during a public hearing at both Planning Commission on July 7, 2020, and Board of Supervisors on September 2, 2020. The Board voted on October 21, 2020 to send the review of this application back to the Planning Commission. The applicant has since revised the application to address concerns and comments heard at these public hearings. This application will again be considered by both the Planning Commission and Board of Supervisors. DISCUSSION: At its meeting on July 7, 2020, the Planning Commission voted 6:0 (Firehock absent) to recommend denial of ZMA201900004. The Planning Commission also denied the requests for private streets, curb and gutter, and planting strips related to standards under the Subdivision Ordinance. The full discussion is included in the Planning Commission minutes, which are linked below. At its meeting on September 2, 2020, the Board of Supervisors held a public hearing on this item and accepted the request for deferral from the applicant at the meeting. Subsequently, the Board took action to defer this application back to the Planning Commission on October 21, 2020. The main concerns discussed at the Board of Supervisors public hearing included density above the Master Plan recommendation, impact to transportation, impact to the residents of Running Deer and Village of Rivanna area, and impact to schools. The applicant has revised the Concept Plan and Proffers to address concerns from the Planning Commission and Board of Supervisors. The following is a summary of changes made since the application was before the Planning Commission and further discussed in the applicant's narrative in Attachment 3: Overall: 1. Density was reduced from 160 units to 130 units. Proffers: 1. Proffer lb was updated to include language that would allow a full vehicular connection at Running Deer Drive, if required by VDOT. 2. Proffer 1c was offered to prohibit construction traffic from using the Running Deer Drive entrance. 3. Proffer 1 i was revised to include the maximum number of units with a reduction from 160 units to 130 units. 4. Proffer 1j was offered to limit the net density for Block 5 to 1 unit per acre. 5. Proffer 1 k was offered to restrict Block 6 to one dwelling via a deed restriction in favor of the future Breezy Hill homeowner's association. 6. Additional technical changes were made at the recommendation of the County Attorney's Office. 7. The total cash contribution for affordable housing was revised in Proffer 4a to account for the reduction in units, from a total of $507,000 for 24 affordable units (160x15%) to $422,500 for 20 affordable units (130x15%). Concept Plan: 1. Street sections were updated to include sidewalk, planting strip, and curb and gutter. 2. Mid -block, multi -use 10' asphalt trails were added. 3. Notation added that the connection at Running Deer Drive would be either emergency access only or a full vehicular connection, if required by VDOT. 4. Mid -block trail standard was revised to be 10' asphalt multi -use trail. 5. A cross section of the stormwater management pond along Route to 250 was provided on sheet 4 that shows how the enhanced extended detention pond works with the 10' multi -use path, landscaping, and preserved steep slopes. 6. Notation added that the lots would not encroach into the stream buffer or preserved slopes on the cover sheet. 7. Notation added that street trees would be provided. 8. Notation added that two layers of erosion and sediment control measures would be provided where development abuts stream buffers. 9. Notation added that no erosion and sediment control measure would be located within the stream buffer. 10. Notation added that grading activities would not be allowed within the stream buffer. 11. Notation added that all construction traffic would enter/exit the site through the main entrance on Route 250 and would not be permitted to use the entrance at Running Deer Drive. 12. Design and alignment of Road B has been reconfigured. UPDATED FACTORS: The factors favorable and unfavorable have been updated below. Those factors that are new or revised are in italics and those factors that have been addressed have a strike through. Factors Favorable: 1. The proposed development includes an entrance as recommended on the "Future Land Use Plan" (Detail Map 2). 2. The proposal includes a multi -use path along US 250, as per the "Future Transportation Network." 3. The proposal includes a (future) vehicular and/or pedestrian interparcel connection to the west across Carrol Creek, as recommended on the "Future Land Use Plan (Detail Map 2)." 4. The proposal's Affordable Housing proffer would generate $422, 500 (max) of monetary contributions to support off -site affordable housing initiatives; or ensure construction of 20 affordable dwelling units (max) for sale or for rent; or an adjusted combination of those outcomes. 5. The proposal meets the applicable Neighborhood Model Principles. Factors Unfavorable: 1. The proposed density exceeds the recommendations in the Master Plan as well as the guidance provided by the Planning Commission at the work session on 7/30/2019. 2. The proposal does not address the transportation improvements identified in the Master Plan as being prerequisite to new development through rezoning. 3. The applicants have not clearly demonstrated that the impacts of the development to transportation facilities and schools has been mitigated. However, the applicant has offered a contribution towards transportation and/or school improvements. 6. The appliGation does not meet %1POT's SeGandaFy Street AGGeptanGe Requirements f9F a- 7. Pursuant to Section 33.22 of the Albemarle County Zoning Ordinance, the Owner hereby voluntarily proffers the conditions listed below which shall be applied to the Property if it is rezoned to the zoning district identified above. The owner and applicant specifically deem the following proffers reasonable and appropriate, as conclusively evidenced by the signature(s) below. 1. Concept Plan: The Property shall be developed in general accord with the plans titled 'Breezy Hill Rezoning Concept Plan" (the "Concept Plan"), prepared by Roudabush Gale & Associates, dated April 23,2019, and last revised November 41, 2020, and shall reflect the following major elements as shown and noted on the plans: a) Primary vehicular connection point at Route 250; b) Secondary vehicular access point at Running Deer Drive is to be installed prior to the issuance of the 311 building permit. The vehicular access at Running Deer Drive shall emergency access only unless a full vehicular connection is required by VDOT. c) During development, construction traffic shall be prohibited from using the Running Deer Drive entrance; d) Future vehicular and/or pedestrian connection points to the west toward Carroll Creek; e) Road typical sections on sheet 1; f) Approximate delineations between blocks and housing typologies assigned to each block; g) Approximate trail, multi -use path, and pedestrian network locations and typical sections on sheet 1; h) Approximate locations and sizes of Blocks, Open Space, stream buffer, and Conservation Areas; i) Maximum density of 1.6 units per acre gross density, or a maximum of 130 residential lots, whichever is less. j) Block 5 shall be limited to a maximum density of 1 unit per acre net density, after factoring out areas designated for "Parks and Green Systems" on the Future Land Use Plan. k) Block 6 shall be limited to a single dwelling unit via a deed restriction in favor of the Breezy Hill homeowners association recorded in the land records. 2. Transportation%Fransit: Intersection Improvements: Prior to issuance of the first (1") Certificate of Occupancy the Owner shall design and install, with input and approval from VDOT, signal timing and coordination improvements to the Route 250 corridor that improve the flow of traffic on Route 250 at its intersections with Route 729 (N. Milton Rd) and Route 22 (Louisa Rd). The Owner shall upgrade the signals to the ASTPM platform using the existing signal equipment at each intersection, as well as new radio communications, controllers, and equipment as necessary to achieve optimal performance. 3. Cash Proffer for Transportation and/or Schools: Prior to the issuance of the tenth (101) Certificate of Occupancy in Breezy Hill the Owner shall contribute Five Hundred Thousand Dollars ($500,000) to the County of Albemarle to be used for transportation, transit, or school capital projects that the County determines will directly benefit the residents of the Village of Rivanna. 4. Affordable Housina: The Owner shall provide affordable housing equal to fifteen percent (15%) of the total residential units constructed on the Property as provided under Proffer 4a, 4b, or 4c: a. Cash Proffer: In lieu of constructing affordable dwelling units "Affordable Units" for fifteen percent (15%) of the total number of Units, the Owner has the option to make a cash contribution to Albemarle County, Piedmont Housing Alliance, Habitat for Humanity, or another local non-profit affordable housing provider in the amount of Twenty One Thousand One Hundred Twenty Five Dollars ($21,125.00) (the "Affordable Housing Cash Proffer") for each such cash -in -lieu -of -construction unit prior to the issuance of a Certificate of Occupancy for that Unit. The Owners total cash contribution will be between $0 Dollars (if all proffered Affordable Units are constructed within the Project) and $422,500 (if zero Affordable Units are constructed within the Project), subject to cost indexing under Proffer 5. b. For -sale Units: The Owner maintains the right to construct and sell all or a portion of the Affordable Units within the Property. Affordability; Credit Thresholds: For the purposes of this Proffer 4(b), "affordable housing" shall mean units affordable to households with incomes less than eighty percent (80%) of the area median income (as determined from time to time by the Virginia Housing Development Authority) such that housing costs consisting of principal, interest, real estate taxes, and homeowners insurance (PITI) do not exceed thirty percent (30%) of the gross household income. ii. Sale of Affordable Units: All purchasers of the for -sale affordable units are subject to approval by Albemarle County. If the Owner has not identified a purchaser and received approval for sale of the Unit to such purchaser from the Community Development Department, the Owner shall provide the Community Development Department a period of 180 days to identify and approve an eligible purchaser for such affordable unit. The 180-day qualification period shall commence upon written notice from the Owner to the Community Development Department of the approximate date the unit is expected to receive a Certificate of Occupancy from the County (the "Notice"). Such Notice shall be given no more than 180 days prior to the expected issuance of the Certificate of Occupancy. Nothing in this Proffer shall prohibit the Owner from identifying an eligible purchaser during the 180-day qualification period. If, during the 180-day qualification period, (i) the Community Development Departments fails to approve a qualified purchaser, or (ii) a qualified purchaser fails to execute a purchase contract for an Affordable Unit, then, in either case, the Owner shall have the right to sell the unit without any restriction on sales price or income of the purchaser, and such unit shall be counted toward the satisfaction of this Proffer 4(b). This Proffer 4(b) shall only apply to the first sale of each of the for -sale affordable units. c. For Rent Units: The Owner maintains the right to construct and rent all or a portion of the Affordable Units within the Property. i. Affordability; Credit Thresholds: For the purposes of this Proffer 4(c), "affordable housing" shall mean units affordable for rent by households with incomes less than eighty percent (80%) of the area median income (as determined from time to time by the Virginia Housing Development Authority) such that rent payments do not exceed thirty percent (30%) of the gross household income. ii. Rental of Affordable Units: All renters of the for -rent affordable units are subject to approval by Albemarle County. Maximum rental amounts to be charged shall be set such that they satisfy Proffer 4(cxi), and shall be adjusted annually to account for changes in the area median income. d. Tracking: Each subdivision plat and site plan for land within the Property shall designate lots or units, as applicable, that will, subject to the terms and conditions of this Proffer 4, satisfy the requirements of this Proffer 4. Such subdivision plat(s) or site plan(s) shall not be required to identify the method by which this Proffer 4 will be satisfied (i.e. 4(a), 4(b), or 4(c)). The aggregate number of such lots or units designated for affordable units within each subdivision plat or site plan shall constitute a minimum of fifteen percent (15%) of the lots or units in such subdivision plat or site plan. The Owner, at the Owner's option, may accelerate the provision of affordable units ahead of the minimum 15% minimum requirement and shall be entitled to receive credit on future subdivision plat(s) or site plan(s) for any such units provided beyond the 15% minimum requirement. 5. Cost Index: Beginning January 1, 2023, the amount of each cash contribution required by Proffer 4 shall be adjusted annually until paid, to reflect any increase or decrease for the proceeding calendar year in the Marshall and Swift Building Cost Index ("MSI"). The annual adjustment shall be made by multiplying the proffered cash contribution amount due for the preceding year by a fraction, the numerator of which shall be the MSI as of December 1 in the preceding calendar year, the denominator of which shall be the MSI as of December 1 in the year preceding the calendar year most recently ended (the "Annual Percentage Change". By way of example, the first annual adjustment shall be $21,125 x 2022 MSI/2021 MSI. Each annual adjustment shall be based on the amount of the proffered cash contribution due for the immediately preceding year based on the formula contained in this Proffer 5 (the amount derived from such formula shall be referred to hereinafter as the "Cash Contribution Due"). For any cash contribution that is being paid in increments, the incremental payments shall be correspondingly adjusted each year. 6. Counterparts: This Proffer Statement may be executed in any number of counterparts, each of which shall be an original and all of which shall constitute but one and the same instrument. Changes to Breezy Hill Since Previous Planning Commission Meeting on July 7, 2020 1. Reduced total overall density to 130 units, which is 1.6 du/ac gross and 1.9 du/ac net. (Last time the PC reviewed this we were proposing 2 du/ac gross or 2.5 du/ac net.) 2. Block 5, which is the 10 acres closest to the existing lots on Running Deer Drive, has been reconfigured as a transitional block, with only 7 lots along the shared boundary line in that block. The existing development along Running Deer has 6 existing lots along the same boundary. Breezy Hill is now compatible along the boundary, providing large lots with density less than 1du/ac net density. (Last time there was no step down in density adjacent to Running Deer properties) 3. Sidewalks, curb & gutter, and street trees are now being offered. The mid -block trails are now proposed as 10' wide multi -use trails, as requested. (Last time we were requesting a sidewalk waiver and a rural road section) 4. Traffic engineer quantified that our proposed improvements to 250 will save the typical Village of Rivanna commuter 2 Y2 minutes on their commute every day. In other terms, that's: a. 10 hours of travel time per year saved for every single commuter. b. 46 total vehicle hours saved each day, or over 11,000 vehicle hours saved per year. (Last time we did not have this much supporting data) 5. The design and alignment of Road B has been reconfigured to meet VDOT standards and discourage traffic from entering and exiting Breezy Hill on Running Deer. Except for the 5 lots fronting on Roads E&F, residents of Breezy Hill would have to backtrack to use the Running Deer entrance, which provides the emergency access desired by VDOT and the County while making daily use physically inconvenient. Additionally, construction traffic will be prohibited from using Running Deer Dr. 6. A deed restriction in favor of the HOA has been offered on Block 6, assuring that only 1 dwelling is ever built on those 22 acres closest to Glenmore. 7. Additional details were offered to assure that the drainage and landscape along 250 are compatible with the character of 250 and don't impact slopes. Additional notes were also proffered to assure that lots will not encroach into any stream buffer or other sensitive environmental area. And notes were added confirming that grading is not allowed in any stream buffer and that beefed up E&S measures will be used adjacent to stream buffers.
