Fisher, Chairman Board of Supervisor, Samuel Miller District 2323 Sheffield West Leigh Charlottesville, Virginia 22901 RE: Sewer Tie-In on Rt. 250 West for Parcel 23B Javor Parcel Dear Mr. Fisher: The Planning Department, upon my request, sent me the Service Area Map regarding properties of Kirtley, Javor and Sieg on Route 250 West (copy attached) . The portions of these properties outside of the South Fork Rivanna Watershed are shown in the darkened area on the map. This is the same drawing displayed at the April 11 , 1984 Board of Supervisors Meeting and discussed with Mr. Elrod, the County Engineer. Offhand, it would seem inequitable that the parcels on either side of 23B, (my 5 acre tract) the Kirtley and Sieg parcels should have that much more of their land area outside of the Rivanna Watershed than my inbetween parcel. This came about, evidently, as the result of previous site grading on the Kirtley and Sieg properties' thereby giving them a broader area of water run-off away from the Rivanna Watershed. My observation is that should the jurisdictional line as shown on the enclosed sheet be adopted by The Board of Supervisors at the May 19th public hearing, it would prove valueless to me as it would encompass only the 75 ' scenic easement set-back which I cannot use for building purposes. I 've met with Mr. Elrod this past week to review the site plan that I submitted to The Planning Commission on March 26 , 1984 , but deferred it pending the outcome of The Board of Supervisors action on the amendment to The Rivanna Jurisdictional Line for the three parcels referred to above. iparlwitED ,`v 2 1984 -',. r:: ' EPT. Fisher, Chairman April 30 , 1984 Page 2 It appears possible that with some minor engineering modification in the grading of my building site, the water run-off could be directed away from the Rivanna Watershed. It would then be possible to tie into the Crozet Interceptor Sewer Line provided the Board of Supervisors amended the jurisdictional line. The engineering studies which are being prepared will show that a gravity flow line to manhole #27 can be reached only 50 yards away on the South side of 250 West from the center of my property line. The following facts further make it essential that public sewer be made available for this 5 acre site: 1) I have a valuable asset in this parcel which I have not been able to utilize for ten years . Taxes have been paid of approximately $1 ,000 per year. 2) The tax base for the County would increase substantially if the property were utilized to its full potential. I am presently paying County taxes of close to $10 ,000 annually on other commercial property I own. 3) The 5 acre parcel is zoned Light Industrial and it is not feasable to install septic tanks and drain fields as The Board of Supervisors acknowledged when they approved my previous site plan with the condition that public sewer be made available to all units. This one condition shut me down as the only public sewer was 2 ,000 ' East on Route 250 . 4) Now that the sewer line is a reasonable 50 yards distance I would be in position to meet this condition. 5) I do not believe The Board of Supervisors would be setting a precedent by amending the jurisdictional line as the three parcels under consideration are unique in that they are zoned Light Industrial or M-1 and encompass a minute area along the route of the sewer line to Crozet. Mr. Gerald E. Fisher, Chairman April 30 , 1984 Page 3 In closing I should like to share some observations on The Crozet Sewer Interceptor. It is my understanding that the line is funded 75% by EPA and the other 25% by a public issue of Revenue Bonds . It would seem that the nature and source of the funding should give every tax paying citizen - of which I am one who kicks in a hefty share to the IRS - the benefit of tying into a sewer line that runs right past his front door. I sincerely hope that The Board of Supervisors in their good judgement and sound reasoning will arrive at a decision at their May 9th meeting that will in all fairness permit me to do something with my property which in the long run would be beneficial to the County and Community.
