Box 1009 401 McINTIRE RD CHARLOTTESVILLE, VA. 22902 (804) 296-5810 L APR 11 1' PLANNING DIVISION April 8, 1988 Mr. William Tucker Rio West Limited Partnership 1705 Seminole Trail Charlottesville, VA 22901 Re: Four Seasons Dear Mr. Tucker: After careful study with Jim Bowling and George St. John I remain satisfied that the ten-inch sanitary sewer line across the Four Seasons Shopping Center property is the Service Authority' s line and can be extended to serve other properties . Although we are unable to find a plat of this easement which the original developer of this property should have recorded, public records clearly show the existence of the sewer line and establish it as a facility to be dedicated to and operated by the Service Authority. This week I was contacted by Jack Collins of the Depart- ment of Health expressing heightened concern about the sewage problem on Benton Patterson' s property. This problem is real and getting worse. No further delays should be tolerated in making an extension of this public sewer line to eliminate a public health problem. You have been quite candid with me in expressing your opposition to doing anything that would perpetuate the existence of the trailer park. I hope you can find some mechanism other than the sewer easement to bring about the changes you would like to see on the neighboring property. I am asking Mr. Patterson to meet with you in one last effort to negotiate for the acquisition of this easement. If a reasonable offer for this easement is rejected I will present a resolution to the Service Authority Board of Directors on April 21, 1988 authorizing the condemnation of that easement.
