Attached is the original staff report of September 8th concerning
this matter. Since the Board of Supervisors preliminary
discussion of this matter staff has been able to further research
some of the background concerning the parcels in question. The
apartment units located on parcel 16A are being treated as
non-conforming uses by the Zoning Administrator. Mr. Martin has
stated that normally four to five residents are in the apartment
building at any one time although there are eleven independent
units. The staff has not been able to obtain -any direct flow
data from the well that serves the apartment units. The units
are essentially single room occupancy type units, therefore,
utilize much less water per unit then a traditional dwelling.
Staff of this Department would recommend approval of the
extension of the jurisdictional areas for water service to
existing structures only to the single family residence on parcel
16B. Staff does not recommend that this water service be
extended to the apartment units.
In the opinion of the staff, extension of water to existing
structures only to parcel 16B in order to correct a demonstrated
deficiency in the onsite water system would be in compliance with
the Comprehensive Plan. Such service to non-conforming
commercial uses would not, in opinion of the staff, be in
compliance with the Comprehensive Plan.

Also attached for the Board' s information is a letter from Mr.
Brent to the Martin' s . As the Board will notice it appears that
extension of a water main to this property would be quite
expensive and would be the responsibility of the property owner
to finance. In the opinion of staff, should the Martin' s find
such an extension not possible, they should investigate
utilization of the flow in the well that currently serves the
apartment units to support the single family dwelling on parcel
16B.

Attached is a letter from Mr. & Mrs. Martin who own property on
Route 250 West behind the Plow & Hearth. The Martin' s own
parcels 16A and 16B on the attached map. The Martin' s single
family home is located on parcel 16B and eleven ( 11) apartments
owned and operated by the Martin' s are located on parcel 16A.
The apartment units are nonconforming uses that were established
with the conversion of an old motel facility into independent
living units. Both parcels are zoned RA, Rural Areas.
Based on the contents of the letter of September 2nd and my
discussions with Mr. & Mrs. Martin at the property, it appears
that their most urgent need is for adequate water supply to their
residence. It appears that they have, in fact, made several
efforts to provide water through onsite wells and have been
unable to do so. In the past the Board has provided water
service to existing structures only in similar cases, including
the parcel immediately to the west owned by the Von Thelenjs.
The connection of the eleven ( 11) apartment units on parcel 16A
is, however, a matter that may merit additional consideration by
the Board of Supervisors. As nonconforming uses in the RA zoning
district the use of parcel 16A for eleven ( 11) living units is
not a use that would usually be approved in a RA zone. If water

usage by those units is exceeding the capacity of the wells it
may be more consistent with the Comprehensive Plan and the Zoning
Ordinance to restrict the number of apartment units as opposed to
providing public utilities in a rural area -in order to support a
nonconforming use. Immediately adjacent to parcel 16A on parcel
16 is the Plow and Hearth which is zoned commercial and parcel
15A contains the 1740 House which may be experiencing similar
water problems. The staff would be concerned about receiving
similar requests for connection to public water for those uses
and the Board, of Supervisors may wish to discuss that
eventuality.
In summary the staff has no objection to the extension of water
to existing structures only to parcel 16B. The staff will need
to research the exact status of the apartments on parcel 16A
prior to formulating a recommendation on that parcel. If you
have any questions, please do not hesitate to contact me.

We are writing to you concerning the possibility of
having county water brought onto our property .
Our property is located on 250 West behind the Plow
and Hearth . We have eleven apartment units and our home
on the property . In 1987 when we built our home we hooked
onto the water system that supplies the apartments as a
temporary source of water , due to the fact that we had sold
our home and needed to be into the new house quickly .
After using this system for a short time , we became worried
about pumping the existing well dry , thus leaving the
apartments without water . Thus our unsuccessful quest for
another water supply began .
In January 1988 we had a well drilled yielding only
about one-half gallon of water per minute . From January
to June we had barely enough water to cook.., and bathe ,
no extras . We have been unable to use the dishwasher or
the washing machine . Using the water sparingly , it lasted
only about three months until trouble presented itself and
the amount of water steadily decreased .
Since June , the water level in the well has been so
low that we have been lucky to get 20 to 30 gallons of
water per day . In June we contacted another well driller ,
and after waiting for two months , the driller finally came
in to drill the well .
Having dug the second hole 305 feet and getting no
water , the driller suggested moving to a different location .
The third hole proved to be just as dissappointing , 365
feet and only one quart of water per minute . At this
point , we were told that the chances of finding water on
this property was slim .
After spending over $5000 trying to get water and the
results being as they are , we do not know where else to
turn . We have talked with other neighbors and they each
have stories of their own water problems , which gives us

even less hope on the water situation .
The Kearsage Subdivision had county water hooked up
back in the Spring because of their wells pumping dry and
the vonThelen family directly behind us has been promised
water in the Spring of 1989 .
We are mounting hope against hope that there might be
some chance of our getting county water extended to our
property .

Dear Mr . and Mrs . Martin:
Following your inquiry about having public water extended
to your property on Route 250 west of Charlottesville the
Board of Supervisors set a public hearing on the inclusion
of your property in the Albemarle County Service Authority ' s
jurisdictional area . This hearing is scheduled later this
month, I believe .
My purpose in writing is not to discourage you in your
hope for water service but to explain the conditions under
which the Albemarle County Service Authority may extend
its water mains . In new developments water mains are installed
by the developer and then dedicated to and accepted by ACSA.
In developed areas (such as your property) , ACSA may extend
its mains if, in ACSA' s opinion, the installation of such
facilities is economically feasible and justifiable and
the finances of ACSA are such as to warrant the necessary
expenditure .
A "ball park" estimate of extending the water main
along Route 250 to your property would be ±$50 , 000 . ACSA
currently has no funds earmarked for an extension of the
Route 250 water main and the revenue to be generated by
a water connection to your property would not be economic
justification for such an expenditure by ACSA.
In the case of Kearsarge , the 21 property owners ' connection
fees helped offset the cost of construction considerably .

and try to answer any questions you may have . Please give
