To Whom it May Concern:
In response to your request for a Letter of Zoning Compliance for the above referenced
Property, please be advised of the following:
The Property is zoned Neighborhood Model District per zoning map amendment
ZMA200100007 " Albemarle Place," approved October 22, 2003 with proffers. This
rezoning has been amended several times. The most recent, ZMA201300009, was
approved on November 13, 2013. The applicable Code of Development, Application
Plan, and Proffers associated with the Property were approved alongside these
rezonings. The associated documents including the Code of Development, Proffers, and
Application Plan can be found using the links provided below.\
• The proposed multifamily residential use is permitted by right under the applicable Code
of Development, Application Plan, and Proffers associated with the Property. The Land
Use Table (Table 1) of the Code of Development establishes the maximum number of
allowable residential units within the designated blocks.
• There are 39 remaining residential units allocated to Blocks A though D. A Special
Exception application (SE202100025) has been submitted to request the transfer of 73
residential units from Block E to Blocks A through D. The requested Special Exception
will be considered by the Board of Supervisors on September 15, 2021. If approved,
SE202100025 will permit 112 new residential units to be built within Block C2-1.
Section 20A.5.i.5 of the Code of Development provides for a maximum building height of
5 stories within Block C by right. The maximum may be increased by special exception.
A Special Exception application (SE202100026) has been submitted to request an
increase in the maximum building height to 7 stories for the proposed 112-unit
residential development on Block C2-1. The requested Special Exception will be
considered by the Board of Supervisors on September 15, 2021. If approved,
SE202100026 will permit the proposed 7- story building on Block C2-1.

• There are several pending or unsatisfied proffers associated with the Property including
proffers 1(C), 2, 5, 6, 12, and 13. You can view the most recent updated proffers list in
the documents attached below for ZMA201100007 and ZMA201300009.
• There are no building or zoning violations on file associated with the Property.
• If the Property contained physical development approved with a site plan, then in the
event of casualty, the Property may be rebuilt substantially in the same form upon
satisfaction of all required building permits and site plans, as applicable.
• Copies of any relevant records may be obtained via the noted links or the Community
Development Department Records Public Access link below. If unable to find the
records, then a request through the department's Records Manager, Paul Bjornsen, at
pbiornsen(a)albemarle.org may be made. If the request is not based in Virginia, it will
take longer to fulfill.
