Variances - March 13 , 1990
Two sets of variances are scheduled for March 13 , 1990 which
represent wholesale "set aside" of the zoning ordinance and
have significant implications as to future decisions.
VA-90-12 S. Vance Williams, Jr. represents twenty-three ( 23 )
variances to create eight ( 8 ) lots . Of greatest concern are
variances to allow six ( 6 ) lots with no septic system
capability and one ( 1) lot with no back-up drainfield
location. One document submitted by the applicant indicates
that the individual purchasers could pursue acquisition of
additional land for septic systems at some future date. If
such land exists , why not create lots consistent with basic
health regulations of the Zoning Ordinance at this time?
Another issue deals with reasonable usage. The current
owner enjoys rental of these units which occupy a very small
portion of the total tract. Certainly, the owner is
realizing a reasonable use of the land and is not deprived
by hardship. The stated purpose of the proposed variances
and subsequent subdivision is to allow ownership by the
various renters . Under the strict language of the Code of
Virginia, do renters enjoy hardship status? While the
county continues to work toward the provision of
low/moderate cost housing, the Department cannot support
substandard development, evidently to be passed on to what
will become low/moderate income homeowners. Twenty-three
( 23 ) variances to create eight ( 8) lots, six ( 6 ) of which
would lack basic plumbing capability, does not appear to be
in the interest of the health, safety and welfare of the
County, and in particular the ultimate owners of those lots .
