Please note that the County Attorney's office stated that if it is wished to continue to use the HOA document to meet most of the 14-317 requirements that it should contain, "Inclusion of ordinance -required terms in the development's covenants, confirmed and documented on the checklist (with citations to the relevant provisions)". That is more generally included in the comments, but wanted to also include that specific wording here. Also/Important: • ACSA and RWSA comments are still pending. • There is a revision to the ACSA easement, on the other side of Berkmar Drive, now shown on the site plan but not included in this plat. If a separate plat is not submitted for this change it should be included in this easement plat. • As noted in the comments I've attached to this email materials that would be utilized in address some of the comments. QUESTION: Is it correct that you only included the Subdivision Plat as a reference document and not as a rebsubmittal? It appears to not have been revised since the previous review and it still shows the easements that will recorded in the easement plat prior to the subdivision plat approval. Therefore it must be updated for that change prior to the next resubmittal. In the email below Andrew B. broached a subject about a pre -manufactured shelter that was mentioned in the agreement with the adjoining property. The plat does not need to show that structure. However, it is associated with the agreement that is being used in lieu of an off -site easement, and that agreement needed to be covered in the comments for the easement plat. For the team, I brought Andrews point to the group and any shelter, foundation or no foundation, should be shown on the site plan if it is proposed and it appears to be. I wanted to broach that now, not only because it is part of the discussion on that agreement but to give you guys a heads up. This was discussed as a movable, cheap, sun blocking outdoor type structure with no foundation and honestly hasnt even been determined yet as to style, but is a potential want from the school and something we verbally agreed to and memorialized in the easement agreement. This in no way shape or form is intended to be a permanent structure or require a foundation. Best Andrew. Although the 8131120 reference is no longer included no reference to which version of the final site plan has been added back in its place. Reference to a version of the site plan that included all proposed changes to the adjoining parcel must be included. This is true both in the first paragraph and the last paragraph. 6 aj ii. Although the bullet for providing the open air shelter has been removed, the bullet for grading for that shelter is still in the document. • 6 aj iii. The "attached exhibit" must be attached to the version of the document that is provided to the County. If you would rather provide an off -site easement (which is the normal requirement) than address all of the planning the comments on the agreement that is your option. IMPORTANT: Please note that email to "Margaret' at the beginning of this string of emails states that you plan to still provide the open air shelter to them even though it is being taken out of the agreement (see the highlighted portions of the email). If that shelter not included in the Berkmar Overlook Site Plan is added to the site of the child care center, after the approval of the Berkmar Overlook site plan, they will be required to do an LOR to their site plan. Adding the shelter to the site plan already under review, so that it can be reviewed for setback etc., seems to be a simpler process and less costly to them then removing it from the agreement.
