Smith, PE 105 West High Street Charlottesville, VA 22902-4596 RE: Subway/Dairy Queen at Forest Lakes Tax Map 32, Parcel 42H SDP-2005-23 Dear Mr. Smith: In your letter of June 23, 2005 you have requested a reduction from 57 to 54 required parking spaces to serve the 1,400 square foot Subway and the 2,578 +421 square foot Dairy Queen with outside tables. In this case, the two restaurants require 57 spaces based on Section 4.12.6 of the ordinance which requires 13 parking spaces per 1,000 square feet of gross floor area for restaurant use. We approve your request with the condition that the two bicycle racks shown on the plan be maintained. This approval is based on your analysis and the additional reasons set forth below. • The parking study, based on the traffic study required by ZMA-91-10, indicates that the maximum number of spaces will are expected to be needed is 48. • The restaurants are located near a large number of residential units and commercial establishments. It is reasonable to expect that some of the patrons of the restaurants will either ride bikes or walk to the site. • Dairy Queen has 9 stacking spaces and the Subway has 5 stacking spaces for the drive through windows. These spaces meet or exceed the requirement for 5 such spaces to serve a restaurant. Please contact me if you have questions or require additional information. Please find attached a reduced copy of the site plan for your reference. As you know, the required parking is determine based on the square footage of each restaurant. The following is the calculation shown on the cover sheet of the site plan package. 13 spaces per 1,000 S.F. gross floor area Dairy Queen: 2,578 S.F. +421 S.F. (outside tables)= 39 spaces Subway: 1,400 S.F. = 18 spaces Total required: = 57 spaces Provided: = 54 spaces As you can see, we are three (3) spaces shy of the amount required by the Zoning Ordinance. The owner feels that it would be very unlikely for the parking lot to be filled at any one time. Below are the justifications of this thinking. One way to look at this is to break the operating hours down into half hour increments and make some reasonable estimates of the percentage of patrons that will visit during those times. Before I go on, you may not be aware that early this year the county staff, the owner and I spent significant time and energy researching and estimating the amount of vehicular traffic for this site. The information and supporting data are too voluminous to include again in this package. But, in a nutshell, the projected traffic figures were determined to be 185 vtpd for Subway and 509 vtpd for Dairy Queen, or a total of 694 vtpd. These numbers were determined using previously determined local area reduction factors, I'1'h information and the top 18 Subways in Virginia. By using reasonable percentage estimates throughout the day we determined the number of parking spaces needed at any given half hour. Please refer to the attached table and chart entitled"Subway/Dairy Queen at Forest Lakes". Further, each restaurant has a drive through window. These patrons are eating and talking on their cell as they drive. So, they will not require a parking space. Figures separating sit down customers from the drive through customers are not available from either restaurant franchise. So, we have made estimates of what we feel are reasonable. Also, the owner would like to encourage non-vehicle patrons to visit from the nearby Forest Lakes Subdivision, Gateway Village Townhouses and the Worth Park office buildings. Sidewalks are available that hopefully will encourage people to walk from their homes or places of work. Maybe if we had too few parking spaces the world would be a healthier place. Also, the site plan indicates the installation of bike rakes for each restaurant. Finally, the owner would like for me to share some other information with you. Precisely that Subway is predominately a luncheon restaurant and Dairy Queen a dinner restaurant. As the owner is a franchisee of other Subway restaurants in Charlottesville, he plans to continue to offer jobs to families (husband and wife, father and daughter, etc.). He already has six applications from Forest Lakes residents. Some are from the same family. I have been told on a number of occasions that time is of the essence.
