This variance approval allows relief from Section 10. 4 of the Albemarle County Zoning Ordinance to reduce the required front yard setback from the right-of-way of Route 643 from 75 feet to 58 feet, a variance of 17 feet; and to reduce the required setback from a private right-of-way from 75 feet to 63 feet, a variance of 12 feet to build an addition to a single-family residence. Patterson Zoning Administrator AMP/st cc: VA-90-29 Inspections Department STAFF REPORT: John Grady PUBLIC HEARING: May 8, 1990 STAFF REPORT - VA-90-29 OWNER/APPLICANT: Henry D. and Lilla Garrison (owners) TAX MAP/PARCEL: 45/52A ZONING: RA, Rural Area ACREAGE: Approximately z acre LOCATION: Located on the east side of Route 643, approximately .2 of a mile south of the Route 743 and Route 643 intersection. REQUEST: The applicant requests relief from Section 10.4 of the Albemarle County Zoning Ordinance, which states: "Area and Bulk Regulations. . . Yards, minimum Front 75 feet. . . " The applicant requests a variance to reduce the required front yard setback from the right-of-way of Route 643 from 75 feet to 58 feet, a variance of 17 feet; and to reduce the required setback from a private road from 75 feet to 63 feet, a variance of 12 feet to build an addition to a single family residence. The applicant 's justification includes: 1. North side of house contains the bedroom area and would also require variances for the front yard and side yard setbacks. 2. Addition to the rear poses multiple problems because of septic tank, drainfield location, relocation of buried fuel tank, relocation of electric meter and would also require almost total renovation of existing kitchen area. 3. Addition to south side is most practical to match existing plumbing. Will be farther away from Route 643 than existing house and farther away from private right-of-way than existing storage shed. 4. The home was built in 1961 and the addition would have met the yard requirements imposed by the 1968 Zoning Ordinance. RECOMMENDATION Staff concurs with the applicant that the proposed area for the new addition does appear to be the most logical location so as to match up well to the existing structure. It is staff's opinion that the applicant does possess undue hardship that is not shared generally, and is not of substantial detriment. The proposed addition would not substantially impact the district, by not encroaching farther that the present structure. No other structures on adjacent property are in close proximity to the proposed addition. Therefore, staff recommends approval for cause. Page 2 Staff Report - VA-90-29 Staff recommends approval for cause: 1. The applicant has provided evidence that the strict application of the ordinance would produce undue hardship; 2. The applicant has provided evidence that such hardship is not shared generally by other properties in the same zoning district and the same vicinity; 3.
