STAFF PERSON: Jan Sprinkle PUBLIC HEARING: October 11, 1994 STAFF REPORT VA-94-13 OWNER/APPLICANT: Charlottesville Shoppers World Limited/Fresh Fields TAX MAP/PARCEL: 61 M/12-1 C ZONING: Planned Development Shopping Center ACREAGE: 12.558 acres LOCATION: The west side of Rt. 29, 0.4 miles south of its intersection with Rio Road in the Shoppers World Shopping Center. REQUEST: There was a discrepancy between the application and the drawing submitted by the applicant. The applicant was contacted and now agrees to requesting the increase in height to only 30 feet as stated on the application. The applicant requests relief from Section 4.15.12.6 of the Albemarle County Zoning Ordinance, which states: "Wall signs, maximum height 20 feet". Please note on the drawing that the noted height of 32 feet has been changed to 30 feet. The applicant seeks a variance to increase the height of a wall sign from 20 feet to 30 feet. This is a variance of 10 feet. The sign is already permitted and currently displayed at 20 feet. It is internally illuminated, has channel letters, and is 171 square feet. The applicant wishes to remount the sign at the 30 feet height. The applicant's justification includes the following: Hardship The ordinance would produce an undue hardship since the current sign location at 20 feet has little or no visibility from Rt. 29 due to the various other buildings on this site. Uniqueness of Hardship This hardship is due to the shape of the shopping center and buildings between this particular building and Rt. 29. Character of the Area There should be no change to the character of the area nor detriment to the adjacent properties as other wall signs in the shopping center are 30 feet in height. Furthermore wall signs at both Fashion Square Mall and Rio Hill Shopping Center were established with a 30 foot height limit. • Tl 1AI u ced.kte LfJ4 ; e -fie. STAFF REPORT - VA-94-13 eA3/41r s). / Y:2. Page 2 y Af\JC. RELEVANT HISTORY: On May 10, 1994 a variance to increase the height to 30 feet for Staples, Inc was approved in this shopping center. Also, in 1992 and 1993, variances for the same height increase for T.J.'s and Advance Auto Store in this same center were both granted. RECOMMENDATION: This request is being heard by the Architecture Review Board on Monday, October 10, 1994. Therefore, their recommendation will be presented at the Board of Zoning Appeals meeting on Tuesday, October 11, 1994. Staff is working towards some minor changes in the sign ordinance to define terminology and correct some errors. One of the proposed changes (subject to Board of Supervisors' approval) will be to allow wall signs the original 30 foot height limit. The 20 foot height limit currently listed for wall signs appears to be an error. Staff recommends approval for cause: 1) The applicant has provided evidence that the strict application of the ordinance would produce undue hardship; The applicant will meet the thirty (30) foot wall height requirement that will be recommended by staff. The error in height of wall signs currently listed in the ordinance may be viewed as a hardship for the applicant in this case. The current sign location offers limited visibility. In fact, they have utilized several temporary banners in the past. The freestanding signage is not available to this business. 2) The applicant has provided evidence that such hardship is not shared generally by other properties in the same zoning district and the same vicinity; Currently wall signs at Shoppers World, Fashion Square, Albemarle Square and Rio Hills shopping centers range in height up to thirty (30) feet. Approval of the recommended changes and correction to the sign ordinance will continue to allow wall signs at a thirty (30) foot height limit. 3) The applicant has provided evidence that the authorization of such variance will not be of substantial detriment to adjacent property and that the character of the district will not be changed by the granting of the variance. Staff agrees that approval of the variance to allow a 30 foot height for this sign will be more visible from Rt. 29 and will be in line with the other signs in the shopping center. Furthermore, approval will place the same 30 foot height limitation on all wall signs should the changes to the sign ordinance be approved by the Board of Supervisors.
