THIS DECLARATION is made this 6th day of January, 1995, by
ROBERT B. ANDERSON and DOMINIQUE E. ANDERSON, husband and wife,
(hereinafter collectively referred to as "the Declarant" ) .
WITNESSETH
WHEREAS, the Declarant is the current owner of a parcel of
land and any improvements thereon and appurtenances thereto situate
in Albemarle County, Virginia, fronting on Highlander Way and
designated as Lot 12 on a subdivision plat of Emerald Ridge of
Steven L. Key, Inc. , dated April 28, 1983, last revised June 15,
1989 , and recorded in the Clerk' s Office of the Circuit Court of
Albemarle County, Virginia, in Deed Book 1054 , pages 492-502, being
in all respects the same property conveyed to the Declarant by deed
of Emerald Land Company dated April 3, 1990, and recorded in the
Clerk' s Office of the Circuit Court of Albemarle County, Virginia,
in Deed Book 1095, page 287 ( "the Property" ) ; and
WHEREAS, the Declarant has applied for and been granted a
variance from the Albemarle County Board of Zoning Appeals allowing
relief from Section 4 . 1 . 6 of the Albemarle County Zoning Ordinance,
which shall permit the Declarant to improve the property with a
single family dwelling with certain conditions imposed as part of
the variance;
WHEREAS, the Declarant desires to declare, for the benefit of
all subsequent grantees of the Property, that certain restrictions
are hereby imposed which shall run with the land and bind all
subsequent grantees;

NOW, THEREFORE, in consideration of the premises and mutual
covenants provided herein, the Declarant states as follows :
Declarant, on behalf of themselves, their heirs, personal
representatives, successors, and assigns, hereby declares that, as
result of the grant of this variance by the Albemarle County Board
of Zoning Appeals and after the Declarant shall have improved the
Property as contemplated in their application, the Property shall
be subject to a restriction that there is available only a fifty
percent ( 50% ) reserve drainfield.
The restriction set forth in this Declaration shall run with
the Property and shall bind the heirs, personal representatives,
successors, and assigns of the Declarant.
