JUSTIFICATION SHALL BE BASED ON THESE THREE (3) CRITERIA:
1) That the strict application of this ordinance would produce
undue hardship.
2) That such hardship is not shared generally by other properties
in the same zoning district and the same vicinity.
3) That the authorization of such variance will not be of
substantial detriment to adjacent property and that the
character of the district will not be changed by the granting
of the variance.
The application may be deferred by the staff or the Board of
Zoning Appeals, if sufficient information necessary to this review
has not be submitted by the deadline.

Dear Ms. McCulley:
The Board of Zoning Appeals approved our request for a variance
(November 9 , 1994 ) to allow for a reduction in the size of the
reserve drainfield on our property in Crozet. In attempting to
conform with the three conditions which were attached to the
variance we have run into another problem.
Condition No. 3 states that we must provide evidence of an easement
on the adjoining lot for septic purpose prior to the issuance of
the building permit. When we originally applied for the variance
we were told by the owners of Lot 10 , Robert and Cindy Brashear,
that they had a contract on Lot 11, adjacent to our lot, and they
gave us a letter which stated their intent to grant us the easement
which was required for the septic field as soon as they went to
settlement on the lot. We have now been informed that the
ownership of the lot is tied up in an estate settlement and it will
probably be several months before the ownership of the lot can be
transferred to the Brashears.
When we asked for the original variance, we explained that with the
easement we would be able to achieve a 70% reserve drainfield.
Without the easement we can only obtain a 50% drainfield. Since
the variance actually states that we have been granted a 50%
drainfield, we would like to request that the condition which
requires that we obtain an easement from the owners of the
neighboring lot be dropped. If this would require an additional
hearing before the Board we would like to proceed at once with the
required procedures.
Our construction has now been delayed since last March and as you
can imagine, we are at our wits end with frustration. Please let us
know as soon as possible what you would recommend as our next step.
