STAFF PERSON: Amelia McCulley PUBLIC HEARING: January 3 , 1995 STAFF REPORT - VA 94-17 OWNER / APPLICANT: (Owner) Daniel D. Shifflett (Applicant) Joe Adlesic TAX MAP / PARCEL: TM 26/ Parcel 12A ZONING: RA, Rural Areas with Flood Hazard Overlay and SS, Scenic Stream Overlay ACREAGE: 6. 43 acres LOCATION: Along the Moormans River on the south side of Rt. 614 , about 0 . 1 mile east of the intersection with Rt. 674 . REQUEST: The applicant requests a variance from Section 30. 5 . 5 . 2 . (d) (6) , Scenic Stream Overlay, to waive a,b, and e. This amendment to a previous variance (VA 87-2 Donald W. Foster) , is to allow construction of a bridge crossing to access a proposed house. The present variance is to add relief from 6a and 6e. The prior variance granted relief from 6b. This variance is necessary due to the facts that neither a house nor a stream crossing currently exist. This Section, from within the Scenic Area-Overlay District uses, states: "Within the immediate environs of any stream designated in section 30 . 5.2 . , no person shall commence any use involving the construction of any structure, the cutting of any living tree over six (6) inches caliper measured at six (6) inches above ground level, or the grading or other like physical alterations of the immediate environs of such stream except as follows: (Amended 9-9-92) . . . d. The following uses by special use permit only; . . . 6. Bridges, causeways and other similar structures designed for pedestrian and/or vehicular access; provided that the board of supervisors shall find, by clear and convincing evidence, in addition to the findings required by section 31.2 . 4 . 1, that: (a) such bridge or other structure is to be located at the site of an existing bridge, ford or other stream crossing; Staff Report VA-94-17 Joe Adelsic Page 2 (b) such existing crossing is regularly used, and such bridge or other structure is to be used, as to the sole means of access to one or more existing, lawfully occupied dwellings; (c) no alternative means of access to such dwellings is physically practicable; (d) no such alternative means of access has been abandoned, aliened or otherwise relinquished by the voluntary act or omission of the owner of the land upon which such dwellings are located since December 10, 1980; (e) such bridge or other structure is necessary to prevent, eliminate or substantially alleviate a hazard to the life or property of any resident of the county; (f) such bridge or other structure is so designed as to pose the minimum practical disruption of the environment of the stream consistent with the other provisions hereof; and (g) such bridge or other structure shall comply with all applicable state and federal law including, but not limited to, Chapters 3 . 5, 7,8, 9 and 20 of Title 62 . 1 of the Code of Virginia (1950) , as amended, to the extent that any or all of the same may be applicable in a particular case. (Added 1-19-83) " This special use permit language is in addition to the standard criteria and requires that the Board make positive findings by clear and convincing evidence of all seven statements (a-g) . On February 17 , 1987 , the Board of Zoning Appeals approved a variance to waive the finding (6b) that this crossing will serve one or several existing, lawfully occupied dwellings. Then, as is the case today, the only remains of a house is a chimney. For reasons unknown, this proposal was not pursued and the accompanying special permit was indefinitely deferred. Staff Report VA-94-17 Joe Adelsic Page 3 HISTORY OF SCENIC STREAM CROSSINGS: Dr. and Mrs. W.D. Buxton applied for VA 82-66 to allow a man-made river crossing to be constructed in the floodway of the Moormans River, a variance of 65 feet. (At the time, there was no special permit provision and the scenic stream setback applied. ) ZTA 82-17 was approved January 19, 1983 to respond to a Zoning Administrator's question regarding the provision of bridges and other like structures in the Scenic Stream Overlay District. The staff report notes "As Staff recalls, a major concern of the Scenic Rivers Committee in drafting the zoning provisions was encroachment of barriers to canoe and other vessel passage. " This amendment added subsection d(6) to Section 30. 5. 5. 2 . On July 6, 1983 , the Board of Supervisors approved SP 83-18 for Dr. and Mrs. W.D. Buxton to allow them to convert a concrete ford to a low-water culvert bridge. This crossing was to serve two dwellings. On August 11, 1993 , the Board approved SP 93-19 for the construction of a footbridge on the adjoining property owned by the Alfords. That property was already served by an open ford. RELEVANT HISTORY ON THIS PROPERTY: A plat by Frank A. Gregg, surveyor dated June, 1972 shows this property as Lot B consisting of 8 . 3 acres. This property was landlocked with the front property line going to the center of the Moormans River. On December 3, 1986, Donald W. and Deborah C. Foster purchased this property from Orbin F. and Adeline R. Carter. In December, 1986, Mr. Foster applied for SP 86-95 for a stream crossing of the floodplain within a scenic stream. In May, it was indefinitely deferred. VA 87-2 Donald W. Foster was approved on February 17, 1987, to allow a bridge to be constructed over the Moormans River. This variance was to provide relief from the requirement that the bridge serve an existing, lawfully occupied dwelling (6b) . A May, 18, 1988 plat by B. Aubrey Huffman and Associates, Ltd. showed this property, Lot B. This plat corrected the acreage to 6. 0 +/- acres from 8 . 3 acres. Staff Report VA-94-17 Joe Adelsic Page 4 The preceding plat was used with the conveyance from the Fosters to Bronius and Barbara Sakalas on May 9, 1988. On September 13, 1990 this same property was sold to Daniel D. Shif f lett. On September 25, 1990, a plat was approved adding an existing lot consisting of 0. 43 acres to this lot. This transaction provided this lot with frontage on Rt 614. The 1991/92 County Real Estate Appraisal shows this property with a value of $9300 and of $7400. The land adjustments section notes "no frontage. River across front of parcel. Have to cross-not easy. " The 1993/94 Appraisal shows a value of $8400. The notes section states "river along ftg. Topo either low or steep. " ******* On August 29, 1994, Mr. Adlesic made application for SP 94-27 . This special permit request is to allow a bridge to be constructed in the floodplain and within the scenic stream overlay. This application has been indefinitely deferred pending hearing of this variance. Once it was under public review by the Planning Commission, the issue was raised regarding the fact that there was no existing house or crossing. The Zoning Administrator determined that the ordinance section was written so as to require that for approval of the special permit relating to the scenic stream, the Board of Supervisors must make positive findings of all subsections (conditions a-g) . The only relief would be to either rewrite the ordinance (a ZTA) or to seek a variance. DESCRIPTION OF THE PROPERTY: As a result of a combination of this property with another unbuildable lot, this property has road frontage on Rt. 614 . It includes the river and extends up to the top of a ridge. This property consists of both bottomland with an area of floodplain and critical slopes with rock outcroppings rising up to the ridgeline. A wet stream exists along a portion of the property between the river and the sloped area. It is grown in mature hardwoods and may likely be classified as consisting of areas of wetlands. This lot is vacant. Property owned by the Alfords is adjacent to the west and is improved with a dwelling and footbridge. In this area, the floodplain is extensive and covers the road, Rt 614 . Staff Report VA-94-17 Joe Adelsic Page 5 The river along this property ranges from wide and shallow to deep and steep. The area proposed for crossing has high banks to require less disturbance for bridge crossing. DESCRIPTION OF PROPOSED CROSSING: The proposed crossing will be a span bridge constructed of steel I-beams with wood decking. It will be located 12-15 feet above the water level. The footings and abutments can be placed on top of the river banks beyond the water's edge. The Virginia Department of Transportation has approved the proposed driveway location. The proposed location will provide the shortest route to the proposed house site. There is no access from adjoining properties. The river frontage would not be easy (if even possible) to ford by most passenger vehicles. APPLICABLE COUNTY LAND USE REGULATIONS: Zoning Ordinance: . The SS, Scenic Stream Overlay District is applied only to the Moormans River. Regulations include limitations to disturbance adjacent to the river, and require a special permit for the construction of certain devices and/or structures. . As previously stated, whether or not this involved a scenic stream, a special permit would be required for a bridge crossing the floodplain. The variance is not originating from the floodplain regulations. The house, a habitable structure shall not be constructed within the floodplain overlay. . The General Regulations within the Zoning Ordinance include requirements relating to the building site and septic site. A full primary and reserve area adequate to serve a 3-bedroom house are required. The building site shall be setback 100 ft from a tributary stream. Water Resource Protection Ordinance (County Code administered by the County Engineering Department) : . This ordinance requires a 100 ft buffer area adjacent to tributary streams and nontidal wetlands. Requests for an exception are permitted, and shall include a water quality impact assessment. In the event this property includes wetlands, an exception to decrease the buffer will be necessary for construction of a home and septic field. Staff Report VA-94-17 Joe Adelsic Page 6 Runoff Control Ordinance (County Code administered by the County Engineering Department) : . This ordinance requires a 100 ft setback from the edge of any tributary stream for the construction of any sewage disposal system. This proposal appears to be in compliance. * As with any construction of this type, the BOCA Code dictates the building specifications. This report will not comment on that aspect. APPLICANT'S JUSTIFICATION: The applicant's justification is found on the variance application. It will be discussed within the proceeding sections. STAFF COMMENT AND RECOMMENDATION: Note: This is not a review of whether or not the bridge special permit should be granted. That is separate action by the Board of Supervisors. Approval of this variance would not guarantee approval of the special permit. A variance of this type can be more complex than others and inevitably considers the question of reasonable use of the property. To provide the statutory context of a variance, portions of the State Code will be shown in excerpt. Section 15. 1-495. 2 of the State Code allows "variance as will not be contrary to the public interest, when, owing to special conditions a literal enforcement of the provisions will result in unnecessary hardship; provided that the spirit of the ordinance shall be observed and substantial justice done . . . " It continues to state that by reason of the exceptional topographic conditions or other extraordinary situation or condition of such piece of property, strict application of the terms of the ordinance would effectively prohibit or alleviate a clearly demonstrable hardship approaching confiscation, as distinguished from a special privilege or convenience sought by the applicant. Without argument, there is an exceptional topographic condition and other situations of this property. Without this crossing, the river would have to be waded by foot. The SS, Scenic Stream overlay district does not allow grading, cutting of trees or other disturbance within 15 ft of the edge of the stream at mean annual flow level. Therefore, it could not be used for a regular crossing of other types of vehicles, such as farming or logging equipment. Staff Report VA-94-17 Joe Adelsic Page 7 The size, shape, slope and other conditions appear to eliminate any typical farming or forestry-related use of the lot even if access were available. There is no evidence that there has been such use of the property. As noted previously in this report, development for a home will present certain other challenges. It appears based on what is currently known that a house could be built subject to agency approvals for building and septic and possibly an exception for wetland buffer. Therefore, it is not a case of creating a buildable lot; instead, it is allowing access to a buildable lot. If it were not for approval of this variance, the lot would not then be buildable except for the hand carrying of materials and equipment across the river. Condition a requires findings that "such bridge or other structure is to be located at the site of an existing bridge, ford or other stream crossing. " The crossing does not exist. However, part of a footbridge is visible at the proposed crossing location, hanging from a tree. It appears to have been destroyed by a former flood. It is not known when it was destroyed. It is clear that it was not designed under current standards and carried only foot traffic. Condition a requires findings that "such bridge or other structure is necessary to prevent, eliminate or substantially alleviate a hazard to the life or property of any resident of the county. " Wading in times of high water is hazardous. Any personal property or animals on the other side would not be accessible and could become flooded during a storm event. In conclusion, staff recommends approval for cause: 1. The applicant has provided evidence that the strict application of the ordinance would produce undue hardship. Without approval of a variance to allow a stream crossing, the property would have to remain in open space and could not be improved with a dwelling. Given the size and other limiting factors, there appears to be no economically viable use of the property. This is in no way a convenience or special privilege for the applicant/property owner. 2 . The applicant has provided evidence that such hardship is not shared generally by other properties in the same zoning district and the same vicinity. Staff Report VA-94-17 Joe Adelsic Page 8 Staff has not conducted a study of all properties to determine how many, if any others, would be similarly situated. It does appear evident that other properties either have existing crossings and/or existing homes, or have alternative access, or have alternative use of the property. 3. The applicant has provided evidence that the authorization of such variance will not be of substantial detriment to adjacent property and that the character of the district will not be changed by the granting of the variance. With regards to the floodplain, the bridge will be designed to create no net increase in the flood levels and it is anchored to prevent downstream damage. The State Scenic River Advisory Committee met to review the proposed special permit. The Committee recommended approval with several conditions. The conditions relate to the natural material construction of the bridge, as well as others relating to the earth disturbance. There is no apparent substantial detriment. It should be noted that this application is to be viewed independently on its own merits, and is not in itself precedent-setting. Should the Board find cause for approval, staff recommends the following conditions: 1. Approval is subject to approval of the special permit for the stream crossing. This shall include, but not be limited to conditions relating to bridge location, materials and construction; 2 . Any bridge expansion is subject to amendment of this variance. Based on the supporting information prepared by the applicant and several field visits to the site, the Department of Engineering recommends issuance of the special use permit subject to the below listed conditions: 1. Engineering approval of final bridge design plans and computations. Because the driveway access onto SR 614 is within the 100 year floodplain, the bridge will not need to be designed to pass the 100 year storm. Instead the structure shall be designed to the same hydrologic standard as the adjacent section of SR 614 and to be structurally stable during the 100 year storm. 2. VDOT approval of the entrance location and right-of-way improvements. 3. Adlesic's application to bridge the Moormans River and to develop recommendations to the Department of Conservation and Recreation on that application. The Committee unanimously voted to send forward the following recommendations: The Committee recommends approval of SP-94-27 with the following conditions: 1. That natural materials be used for railings and facades of abutments in order to minimize the visual intrusion of the structure from the river. The suggested material for raiiings was wood and for abutments was stone facing or aggregate. 2. That paint containing lead not be used, so as to eliminate the danger of lead entering the stream. 3. That no introduction of invasive or non-native species be made in the re-seeding of the disturbed ground area. 4. That a 50 foot buffer of natural vegetation be maintained with only minimal distrubance necessary for maintaining a view or path. Such a buffer will not only lessen the visual impact from the river but be a benefit to maintenance to the river's superior water quality in times of high water. The following considerations figured in the Committee's deliberations and the members wish to record them here in order to inform any future deliberations on crossings of the Moormans. 1. Granting a crossing in this location does not alter the historical use and access of the parcel. The parcel is a parent and not a derivative parcel unsubdivided since before the turn of the century. McCulley, Zoning Administrator f`�DATE: October 27 , 1994 RE: S.P. 94-27 Joseph Adlesic Stream Crossing This is an official determination in response to the questions which arose at the Planning Commission meeting on this application. The issue at hand is whether this stream crossing may be approved if the Board is unable to make positive findings for all of the conditions for issuance of a special permit for crossing a scenic stream (Section 30 . 5. 5 . 2 .d. 6) . It is my opinion that the Ordinance requires that there are positive findings for each condition. If any or several findings can not be positively made, absent a variance granted by the Board of Zoning Appeals, the application would not meet the requirements for approval . The language of this section lists crossings by special permit and explicitly states "provided that the board of supervisors shall find, by clear and convincing evidence, in addition to the findings required by section 31 . 2 . 4 . 1, that" and lists a through g. The fact that these findings are inclusive is evidenced by the use of semicolons at each condition and by the conjunctive word "and" just previous to the final condition in the list. This subsection of the Scenic Areas Overlay District was amended to include this list of findings on January 19 , 1983 . This zoning text amendment was a result from a request to the Zoning Administrator by Dr . and Mrs . W. D. Buxton, for improving an existing ford to allow access to their residence during high water. The staff report notes the following: As staff recalls, a major concern of the Scenic Rivers Committee in drafting the zoning provisions was encroachment of barriers to canoe and other vessel passage. To this end, uses permitted by right were intentionally limited. In view of this background, it may be appropriate to include language in the amendment which would require design to V.
