RE: Cafe No Problem
Dear Mr. Cooper,
The intent of this letter is to advise you on the procedures for approval of the site plan for Cafe
No Problem. The site plan will be processed as a major site plan amendment. This will involve
submittal of plans by a submittal deadline, review by the site review committee, and potentially
review by the Planning Commission. For your use I have provided a copy of the site plan
submittal schedule and a copy of the administrative review procedures. While the procedures
speak directly to preliminary and final plans the procedures are applicable to major site plans
amendments. The submitted plan must contain the minimum information required by Section
32.6 of the Zoning Ordinance. An additional fee of$140 is required as are a total of 12 copies of
the plan satisfying the requirements of Section 32.6. A total of 3 plans have been submitted to
date and these have not been reviewed for compliance with Section 32.6.
Staff has identified other issues which must be addressed prior to approval of the site plan. The
issue of the Albemarle County Service Authority jurisdictional area must be resolved. This
would best be resolved prior to review of the site plan as the actions of the Board could affect the
design of the project. The limitation on use of public sewer is "discharge shall be based in the
State's criteria to serve the existing structure, existing use and existing capacity only". Any
expansion of the building, other than interior renovations and facade treatments would constitute
a building expansion which would not be permitted. Any change or expansion of the use from
the previous use as a restaurant would not be permitted. This would include your proposal for an
apartment and any increase in seating. The capacity of the system could best be determined by
the provision of information as to the Health Department approvals forthe previous septic
system. Any request for amendment of the limitations on the use of sewer should include

information as to the nature and scale of the revisions to the building (the site plan could provide
this information), the intended use of the site and the anticipated flows based on residential use
and the seating capacity of the restaurant. This information should be forwarded to me as soon
as possible to allow sdheduling of the proposed change in use of public sewer with the Board of
Supervisors. This information should accompany the jurisdictional boundary amendment
application which Wayne Cilimberg has provided to you. The issue of use of public sewer must
be resolved prior to site plan approval.
The Zoning Department has informed me that variances will be required to allow for the
proposed changes to the site. All needed variances must be obtained prior to approval of the site
plan. It would be most appropriate to obtain any needed variances prior to submittal of the site
plan as the actions by the Board of Zoning Appeals could affect the design of the project. All
applications and conversations regarding variances should be directed to the Zoning Department
and Amelia McCulley, 296-5875.
Prior to approval of the site plan a certificate of appropriateness must be obtained from the
Architectural Review Board. All applications and questions regarding a certificate of
appropriateness should be directed to the Design Planner, Marcia Joseph at 296-5875. Her office
is located in the Zoning Department.
Several issues involve the Engineering Department. Jack Kelsey and David Hirschman can
provide you with more detailed information on the issues. They may be contacted at 296-5861.
I will try to provide you with general information as to those items which should be discussed
with the Engineering Department.
The location of the floodplain must be determined by the submittal of information indicating the
location of the floodplain. Any activities in the floodplain may require the submittal of a special
use permit in accord with the provisions of Section 30.3. Habitable structures may not be located
in the floodplain. The Zoning Department has stated that concrete has been placed near/in the
creek. The Zoning Department has cited the activity which has occurred in the floodplain as a
violation. This must be removed or a special use permit applied for. The polioy of the Planning
Commission is not to review any applications for sites which have active violations unless the
application addresses the violation directly.
A runoff control permit is required and review for impact on the Water Resource Protection
Areas must occur. These issues are best addressed by contacting David Hirschman, 296-5861.
Mr. Hirschman has asked me to enclose information on bioretention which you requested from
him last week. This information relates to possible measures proposed in your runoff control
permit application.

Regarding the pump station you will need the following:
a. State Health Department approval of the pump station, this must come from the
Lexington office;
b. Once the puml3 station is constructed you will need:
1. Certification from a licensed engineer that the pump station is built in accordance
with.the approved plans;
2. Submittal of an "operation manual" to the State Health Department office in
Lexington;
3. Receipt of a "certificate to operate" from the State Health Department in
Lexington. This can be obtained only after items 1 and 2 have been completed.
c. Approval of billing method for use of the public sewer system from the'Albemarle
County Service Authority. This will most likely require metering of the well. You may
wish to contact Paul Shoop at 977-4511 for more information;
d. Runoff control permit. The tanks are within the 100 foot septic setback. The tanks will
have to be moved as the Runoff Control Ordinance has no provisions for waivers.
The mixture of residential and commercial uses has been identified as a concern due to the
building code. Please contact Jay Schlothauer at 296-5832 to address this issue and any others
relating to the building code. I strongly encourage you to discuss these issues prior to submittal
of the site plan as the answers may affect the design of the project.
