JUSTIFICATION SHALL BE BASED ON THESE THREE (3) CRITERIA:
1) That the strict application of this ordinance would produce
undue hardship.

in the same zoning district and the same vicinity.

substantial detriment to adjacent property and that the

VARIANCE APPLICATION
TAX MAP 76 PARCEL 12F
Description request: Request is made to reduce building and parking set-backs to
five (5) feet on the north and south property lines which will permit the construction
of a 2 story architect's office (which may include his personal residence) of
approximately 4,200 sq. ft.
Justification:
1. Strict application of this ordinance would produce undue hardship by
unreasonably restricting, and effectively prohibiting,the use of this property.
The unique shape and topographic characteristics of this property, when combined
with the required building set-backs of the ordinance, prevent the reasonable use of
this property. This is a clearly demonstratable hardship, approaching confiscation.
2. This hardship is not shared generally by other properties in the same zoning
district and same vicinity.
Neighboring properties of various shape and topography have not had their use
totally prohibited. Granting the requested variance, would simply allow the rightful
and legal use of this property, and thus alleviate an unreasonable hardship as
distinguished from a special privilege or convenience.
3. The authorization of such variance will not be a substantial detriment to the
adjacent property and the character of the district will not be changed by the granting
of the variance.

If authorized, the proposed variance will have no detrimental effect on the adjacent
drainage easement and permanent wooded area to the south, nor to the wooded area
which is to remain along the north property line. The careful, sensitive, and
environmentally responsive design of the proposed building will only serve to
improve the character of the district, which is currently represented by the
foundation ruins of a long-unfinished car dealership, an abandoned Chinese
restaurant and a heavy equipment parking lot belonging to the Forrest Service.
In considering this request, it is important to acknowledge the proposed building is
only 36 +/- feet wide and is not expected to vary significantly from that dimension.
Relative to the lot frontage the narrow building face will be the only portion of this
simple classical building that will face the roadway along the entire 300' length of
the property line.
In addition,please note that the parking arrangement indicated on the accompanying
schematic site plan has not been fully thought through and some adjustments in the
final parking layout should be expected.
