Applicant requests a variance to reduce the side yard from 25 ft to 19 ft. \qlr\ DESCRIPTION OF REQUEST: P}‘C,V►ciA JUSTIFICATION SHALL BE BASED ON THESE THREE (3) CRITERIA: 1) That the strict application of this ordinance would produce undue hardship. 2) That such hardship is not shared generally by other properties in the same zoning district and the same vicinity. 3) That the authorization of such variance will not be of substantial detriment to adjacent property and that the character of the district will not be changed by the granting of the variance. DESCRIPTION OF REQUEST: We are requesting a six foot variance from the set-back requirement for our side-lot. We want to build an addition that would extend seven feet from the side of the house. We have twenty-eight feet of land on the side where we need to build, and the set-back requirement is twenty-five feet. Thus, the addition would extend four feet over the set-back line. We are requesting a six foot variance to ensure the addition would be well within the limits. The house is a small,old farmhouse(built 1920) at 1545 Old Ballard Rd. 1. The strict application of this ordinance would produce undue hardship for several reasons: A. Currently,the sole bathroom in the house only has room for a tub and a toilet; the sink is in the hall, outside the master bedroom. This is an extreme hardship now,but will be impossibly cramped when we have young children who need assistance in the bathroom,as the current bathroom barely fits one adult. There is no room for an adult and a child within the bathroom, nor is there room for a booster in the hall for a child to reach the sink. A small addition would allow us to put the sink in the bathroom, as well as add a half-bath downstairs. B. Right now, we have more of a dining space than a dining room. There is not enough space for more than two people to dine comfortably. When we have children,the crowding problem will become an even greater hardship. Putting a high chair in this space will make things impossibly cramped. A small addition would allow us to expand the existing dining room. Why we can't build on the other three sides of the house: The Back of the house: A. Continued Hardship: Building off the back would not allow us to remove the bathroom sink from the hall --you could only reach a new bathroom at the back of the house by walking through the master bedroom. If we attempted to build a dining room onto the back of the house, with a bathroom upstairs, we would have to walk from the kitchen,through the existing dining space, down two steps, and across the family room, with food and dishes. B. Trees: Two old growth red maples shade the back of the house. Both of these would have their roots damaged by an addition on the back of the house, and might have to be removed to permit an addition. C. Preserving the original architectural style of the house: If we add on to the back, we would be adding out from an existing addition. The house would become unusually long, and would severely diminish the character of the original house. The Other Side: A. Continued Hardship: We would not be able to expand the existing bathroom or the dining room, leaving us with the original problem which gave rise to the variance. The new bathroom could only be reached by walking through another bedroom. Elizabeth Outka Variance Request 1545 Old Ballard Rd. B. Preserving the original architectural style of the house: Again,building off the other side of the house (the side which you see from the road) would destroy the look of the original farmhouse. We'd also have to dismantle part of the porch. The Front: A. Continued Hardship: If we attempted to build onto the front of the house, the dining room would again be far from the kitchen. The bathroom would only be accessible through one bedroom. B. Preserving the original architectural style of the house: We would have to dismantle the front porch. Unless we restructured the whole front of the house, the entire character of the house would be ruined. 2. Most of the houses in our neighborhood are relatively new, and were originally designed with indoor plumbing. Our house was built in 1920,without any indoor plumbing planned. Plumbing was added later(we think around 1978), and had to be fit into the existing house. We highly doubt that any house in the neighborhood shares our problems (sink in the hall,etc.). 3. The border we share with our neighbors is well-shielded by trees and bushes. An addition of seven feet would cause no detriment to the adjacent property. We have talked with our neighbors several times about the addition, and have shown them detailed plans of what we would like to build. They have NO problems with it(they'd be happy to write a letter expressing this if you need it). We have asked them if they would consider a land swap, which would allow us to avoid asking for a variance. They have refused. The addition would not in any way change the character of the district. The addition itself would be very hard to see from the street, as evergreens block most of the view from that side. Actually, an addition on any other side of the house would, in fact, change the look of the house, and would adversely impact the character of the district. .
