Dear Mr.Cook:
As you know Qual Choice has installed a sign at their facility which you have found to be in violation of the Zoning Ordinance
due to the height above ground at which it is mounted. Qual Choice wishes to apply for a variance that allows the sign to
remain at the current location. We offer the following justification,as required by the County:
JUSTIFICATION:
1) HARDSHIP TO QUAL CHOICE.
The original intention was to locate this sign at the spandrel between the first and second floor. This would have
satisfied the height limit.When the installer attempted to attach the sign at the lower spandrel, a steel beam was
encountered. The anchorage system employed was not compatible with a steel beam substrate. Drilling into the beam
would be required. Compromising the structure was deemed ill; 1vised. The upper location did not require drilling a
structural member.
Additionally we hope you will consider that Qual Choice is a secont. floor tenant. with the sign located above their
storey,the correct identity is established. Should the sign be located between floors it would be difficult to ascertain
whether it referred to the lower level tenant or the upper.
2) HARDSHIP COMPARISON TO ADJACENT PROPERTIES:
We have no information on other buildings in the area where the structural system makes fastening a sign difficult.
However,to the best of our knowledge,no other building in the area h as to upper level tenant that is different from the
lower level tenants. Thus no standard for multiple storey identificatio i has been established.
3) DETRIMENT TO ADJACENT PROPERTIES:
The corridor that is Route 29 is replete with commercial advertising,much of which is robust and vigorous. The Qual
Choice sign is rather restrained compared to many in the area. Further this sign is smaller than the maximum allowed
by the ordinance. Qual Choice could install a larger sign at the lower location without a variance. It could be argued
that a larger sign would have a more detrimental effect than a higher, smaller one. Qual Choice would waive any right
to additional signage should the variance allowing the higher location be granted. Perhaps this points the way for
allowing signage above the height limit provided the total square footage is reduced.
4) PREVIOUS SIGN:
You may also wish to consider the sign previously installed on this building when it contained the antique dealer. This
sign was near in height above grade as the current Qual Choice sign. It has been removed, and with the installation of
the new Qual Choice sign the overall situation is very similar to tl'e previous tenant.
