on the NE side of Rio Rd behind the existing Putt-Putt Golf & Bonanza
Family Restaurant. TM61/P124E, zoned HC, Cl & R15. Applicants request a
variance to reduce the setback adjacent to residential districts (R10 &
R15) from 50 ft for structures to 0 (zero) and from a future public road
(currently reserved for dedication upon demand by Albemarle County) from
30 ft to 10 ft. \qlr\
DESCRIPTION OF REQUEST: Variance to allow iutt fron setback from
Putt-Putt lane; loft side setback from 40 ft. strip reserved for future road,
zero side setback from Parcel 124E1, and zero rear setback from Parcel 124C and
residue of Parcel 124E.
JUSTIFICATION SHALL BE BASED ON THESE THREE (3) CRITERIA:
1) That the strict application of this ordinance would produce
undue hardship.
County required 61ft. private access esm't where normally private access
easements are only 30ft. wide.
2) That such hardship is not shared generally by other properties
in the same zoning district and the same vicinity.
This size R/0/W reservation not generally required at other
properties in this area.

3) That the authorization of such variance will not be of
substantial detriment to adjacent property and that the.
character of the district will not be changed by the granting
of the variance.
Walls of structures will have no doors and window openings adjacent to other
properties; All structures, except office will be unoccupied areas, no activity
on-site will be visible from street or adjacent properties. Proposed use will
generate less traffic volumes that other permitted areas. Front setback from
actual pavement varies from 22 ft. to 38 ft.
The application may be deferred by the staff or the Board of
Zoning Appeals, if sufficient information necessary to this review
has not be submitted by the deadline.
