Re: VA-95-17, Relief from commercial to residential setback requirement
Dear Mr. Chairman:
Encore Investors Limited Partnership is the owner of parcel 124C, Tax Map 61. Parcel 124C
is adjacent to Parcel 124E, the parcel for which the setback variance has been requested. Encore
also owns parcels 124A and 124B. The self storage facility proposed for parcel 124E and the
approximate property lines for the three Encore parcels have been drawn on the enclosed
topographic map of the area.
Parcels 124A and 124B and the front portion of parcel 124C are zoned Commercial Office(CO).
The rear portion of 124C, which is where the variance is requested, is currently zoned
Residential (R-10). While the Comprehensive Plan anticipates low intensity commercial use for
all of these parcels, only the building on the front portion of 124C has any history of commercial
use. More importantly, Encore is presently negotiating with a company interested in a
significant part of the rear portion of 124C for an R-10 use.
In spite of the current zoning and the possibility of an R-10 use on Parcel 124C, Encore does
not oppose a reduction in the 50' building setback requirement subject to several conditions, all
of which we believe are compatible with the use proposed for Parcel 124E. Encore requests that
any approval for reduction in the setback be conditioned such that:
1) The setback be reduced ONLY for the construction of a self storage facility of the
configuration shown on an October 17, 1995 rezoning application plan, prepared
by the applicant in support of a rezoning application which is a companion to VA-
95-17.
2) The proposed storage facility walls adjacent to the existing Putt-Putt and adjacent
to parcel 124C and extending northward past the corner of parcel 124C, both of
which will be visible from Parcel 124C, be of brick or other material approved
by Encore, its successors or assigns. Further, the wall shall incorporate
architectural features to create shade and shadow in order to prevent monotony.

3) The roof of the storage facility be a either a flat or nearly flat roof, not visible
from parcel 124C by an observer with height of eye of 6', or if another type of
roof which is visible, be a standing seam metal roof or other type of roof
approved by Encore, its successors or assigns.
4) The setback adjacent to Parcel 124C be reduced from 50' to not less than 3', and
that the 3' strip be planted with tall columnar plantings or with plantings such as
pyracantha which are espaliered to the wall and maintained by the owner/user of
parcel 124E.
