High Street Charlottesville, VA 22902 RE: SP201900005 Flow VW Mazda Special Use Permit — Outdoor Sales, Storage, Display Dear Mr. Shimp: Your request for Special Use Permit SP201900005 for outdoor sales, storage and display for Flow VW and Mazda has been reviewed by members of Albemarle County staff and our partner agencies. Review comments are provided below, organized by Department, Division, or agency. There are issues that we believe should be resolved before requesting a public hearing with the Planning Commission. We are available to assist you in addressing these issues. Plannin Comprehensive Plan Initial comments on how your proposal generally relates to the Albemarle County Comprehensive Plan (Comp Plan) are provided below. Comments regarding conformity with the Comp Plan will be provided to the PC and BOS as part of the staff report. The Comp Plan designates the subject property for Urban Mixed Use and Urban Density residential in Neighborhood 3 of the Pantops Master Plan area. Urban mixed uses include retail, commercial services and office, so this proposal is consistent with the Comp Plan. The Comp Plan (Chapter 2, Natural Resources and Cultural Assets) establishes the goals for preserving the scenic resources that are essential to the County's character, economic vitality and quality of life. The Entrance Corridor Overlay District is intended to support that goal by maintaining the visual integrity of the County's roadways. The Architectural Review Board addresses potential adverse aesthetic impacts in the Entrance Corridors by applying the County's Entrance Corridor Design Guidelines during their review of development proposals. The ARB reviewed the subject request for conformance with the Design Guidelines on May 20, 2019 and is scheduled to review a revised proposal on August 5, 2019. It is recommended that this application not move forward to the Planning Commission without a favorable recommendation from the ARB. Protection of the Monticello Viewshed is an objective outlined in the Comp Plan. The parcels that are the subject of this application fall within the Monticello Viewshed and might be visible from the Monticello mountaintop. Please contact Liz Russell, Project and Planning Assistant at Monticello, to determine actual visibility and to discuss potential visual impacts, then share the results of your contact with us. (Our staff report prepared for the Planning Commission will note the status of your contact.) Liz can be reached at 434-984-7589 and at ]russellamonticello.org. Community Meeting On July 2 and 3 we exchanged information regarding the required community meeting. We noted that the Pantops CAC is the appropriate venue for this meeting, and that CAC meets on the 4`" Monday of the month. A list of property owners to be notified, and a sample invitation letter were emailed to you on July 3. Note that additional comments regarding impacts to neighboring properties may be forthcoming after the community meeting. Zoning The following comments related to zoning matters have been provided by Kevin McCollum and Francis MacCall: 1. Identify total square footage of display area. 2. The application needs to address Supplemental Regulations Section 5.1.31 for vehicles awaiting repair. The potential staging areas for vehicles waiting repair shall be identified and any necessary screening shall be addressed. See 5.1.31 a: d. Engineering The following comments related to engineering have been provided by Frank Pohl: a No objection. Building Official The following comments have been provided by Michael Dellinger: a All comments were provided with the Initial Site Plan. Transportation Planning a The following comments have been provided by Daniel Butch A major improvement for the Rt. 250/Rt. 20 intersection is fully funded in Fiscal Year 2023. This project proposes additional turn lanes and rebuilds the signal system to increase intersection capacity and reduce delay. It will add an additional right turn lane and bike lane on Rt. 250 westbound onto Rt. 20 northbound which will require additional right-of-way on Rt. 250 by VDOT. Please provide a scenerio showing the display parking area after the intersection improvements would be completed. a The following comments have been provided by Margaret Maliszewski: The Rt. 250/Rt. 20 intersection improvements are identified as a capital project in the adopted Pantops Master Plan. Reservation of the land required for the intersection improvements is recommended. VDOT The following comments related to transportation have been provided by Adam Moore of VDOT. (The complete letter is attached.) The Department of Transportation, Charlottesville Residency Transportation and Land Use Section, has reviewed the above referenced plan as submitted by Shimp Engineering, P.C., dated May 30, 2019 and offer the following comments. Land Use 1. Please provide a truck circulation diagram for vehicle delivery trucks. 2. The proposed entrance doesn't meet VDQT's requirement on spacing distance. Please see VDOT's Road Design Manual appendix F-pg., F-23., minimum spacing standards for commercial entrances, Intersections, and median crossovers, Route 20 is a minor arterial road and the speed limit is 35 inph, spacing distance required is 660'. (For entrances across or 440' if not aligned,) An AME application will need to be submitted and reviewed. 3. The County's Pantops toaster plan has called for a continuous right turn lane along Route 250 in this area. The County may require frontage improvements in this area. Please provide two copies of the revised plan along with a comment response letter. If further information is desired, please contact Willis C. Bedsaul at 434-422-9866. A VDOT Land Use Permit will be required prior to any work within the right of way. The ownerldevcloper must contact the Charlottesville Residency land Use Section at (434) 422-9399 for information pertaining to this process. Albemarle County Service Authority ACSA • The following comments have been provided by Richard Nelson: 1) Is this site in the jurisdictional area for water and/or sewer? Yes 2) What is the distance to the closest water and sewer line, if in the jurisdictional area? Parcel is currently served by water. 3) Are there water pressure issues which may affect the proposed use as shown on plan? Water pressure is high in this area. Building should currently have a PRV. 4) Are there major upgrades needed to the water distribution or sewer collection system of which the applicant and staff should be aware? N/A 5) Are there other service provision issues such as the need for grinder pumps? A backflow will be required. 6) Which issues should be resolved at the SP/ZMA stage and which issues can be resolved at the site plan/plat stage? 7) If the project is a large water user, what long term impacts or implications do you forsee? 8) Additional comments? Ensure ACSA can access sewer manhole in parking lot. Entrance Corridor Architectural Review Board (ARB) review is ongoing. This proposal was reviewed by the ARB on May 20, 2019. Comments from that meeting were provided previously and are copied below. A second review with the ARB is scheduled for August 5. Note that the planned Rt. 250/Rt. 20 intersection improvements will significantly impact the display parking as initially proposed. Staff will not be able to recommend approval of the proposal without a design illustrating appropriate sales, storage and display following the intersection improvements. VDOT's requirements regarding entrance spacing (see VDOT comments below) could impact the location of sales, storage and display parking spaces. Because the approval of Special Use Permits for this particular type of use are associated with a plan illustrating specific locations of individual parking spaces, the entrance location should be settled prior to public hearing. This will avoid the need for an amendment to the Special Use Permit in the future. It is recommended that this project not move forward to the Planning Commission without a favorable recommendation from the ARB. Also, please note the following general site plan comments: 1. Please include the star hatching in the key on Sheet C5. 2. Identify all parking spaces by type: display, customer, employee, vehicles awaiting repair, etc. 3. Please be sure that all setbacks and all parking area minimum design standards have been met so that it is clear that all parking spaces are approvable as shown. Rivanna Water and Sewer Authority (RWSA) The following RWSA comments have been provided (below) by Victoria Fort: 1. Capacity issues for sewer that may affect this proposal None Known 2. Note that recommended conditions may change as the proposal changes and review progresses. 1. Development shall be in general accord with the plan titled `XXX" prepared by XX dated X (hereafter "Concept Plan"), as determined by the Director of Planning and the Zoning Administrator. To be in general accord with the Concept Plan, development and use shall reflect the following major elements as shown on the plan: XXX. 2. Vehicles shall be stored or displayed only in areas indicated for display shown on the plan titled "XXX" dated XX/XX/20XX. 3. Vehicles for display shall be parked in striped parking spaces. 4. Vehicles shall not be elevated anywhere outside of a building on site. 5. Final site plan approval is subject to ARB approval of the lighting plan (submitted with the site plan). Maximum height of new pole lights (including bases and fixtures), shall not exceed 20'. Maximum light levels shall not exceed 30 footcandles in the display lot and 20 footcandles in all other locations. 6. Final site plan approval is subject to ARB approval of the landscape plan (submitted with the site plan). Landscaping shown on the plan may be required to be in excess of the minimum requirements of the ARB guidelines and/or the Zoning Ordinance to mitigate visual impacts of the proposed use, and shall include, but not be limited to, the following: X300M 7. Reservation of the right-of-way required to accommodate the planned intersection improvements is recommended. Please provide a written request and state your justification for requesting the deferral. (indefinite deferral means that you intend to resubmit/request a public hearing be set with the Planning Commission after the 30 day period.) (3) Request Planning Commission Public Hearing Date be Set At this time, you may schedule a public hearing with the Planning Commission. However, we do not advise that you go directly to public hearing if staff has identified issues in need of resolution that can be addressed with a resubmittal. After outstanding issues have been resolved and/or when you are ready to request a public hearing, staff will set your public hearing date for the Planning Commission in accordance with the Planning Commission's published schedule and as mutually agreed by you and the County. The staff report and recommendation will be based on the latest information provided by you with your initial submittal or resubmittal. Please remember that all resubmittals must be made on or before a resubmittal date. By no later than twenty-one (21) days before the Planning Commission's public hearing, a newspaper advertisement fee and an adjoining owner notification fee must be paid. (See attached Fee Schedule) Your comment letter will contain the actual fees you need to pay. Payment for an additional newspaper advertisement is also required twenty-two (22) days prior to the Board of Supervisors public hearing. Please be advised that, once a public hearing has been advertised, only one deferral prior to the Planning Commission's public hearing will be allowed during the life of the application. The only exception to this rule will be extraordinary circumstances, such as a major change in the project proposal by the applicant or more issues identified by staff that have not previously been brought to the applicant's attention. As always, an applicant may request deferral at the Planning Commission meeting.
