N`U DESCRIPTION OF REQUEST: Temporary variance from section 4.12.6.6.1
Q� parking requirements to allow fewer parking spaces for 60 days while existing
5� building is being demolished for new parking. 537 spaces will be provided
for new building while existing building is being removed. The final count
will be 878 spaces.
JUSTIFICATION SHALL BE BASED ON THERE THREE (3) CRITERIA:
1) That the strict application of this ordinance would produce
undue hardship.
Strict enforcement of the ordinance would prevent the new facility to open
without first demolishing the existing store which would result in
unacceptable loss of revenue.
2) That such hardship is not shared generally by other properties
in the same zoning district and the same vicinity.
Very few entities have to or are willing to demolish their other facilities
to construct new ones.
3) That the authorization of such variance will not be of
substantial detriment to adjacent property and that the
character of the district will not be changed by the granting
of the variance.
The request is for only 60 days. in which time LoWP's agrees to delay grand
opening until after th total R7R spac s are in place_ therefore PXl PCc
parking overflow is not expected.
The application may be deferred by the staff or the Board of
Zoning Appeals, if sufficient information necessary to this review
has not be submitted by the deadline.
