To Whom it May Concern:
In response to your request for a Letter of Zoning Compliance for the above -referenced
Property, please be advised of the following:
• The Property is zoned Rural Areas, RA. The permitted uses of the Property are provided in
Section 10 of Chapter 18 of the Albemarle County Code (the "Zoning Ordinance"). The
Property is subject to the Entrance Corridor ("EC") Overlay District as described in Section
30 of the Zoning Ordinance.
• The use of the Property has been considered a nonconforming gasoline service station and
bulk distribution center for gasoline and fuel oil for GOCO Inc, as various County approvals
have been granted to allow the use to continue on the Property.
A review of County Zoning records does not indicate a determination of the Property being
considered a Country store, Class A as defined in Section 3 of the Zoning Ordinance.
Suppose the owner provides evidence that the Property has been operated as a Country
store prior to January 1, 1969. In that case, it may be considered a Country store, Class A.
A Country store, Class B, is only permitted with the approval of a Special Use Permit by the
Albemarle County Board of Supervisors.
A review of our files found (i) a complaint was filed in July 2021 regarding various
debris collecting on the Property. Staff followed up with the owner and was informed
that the materials would be cleaned up. A site visit in September revealed that that
materials had been removed. The Property owner was not cited with an official
violation as compliance was reached before that action being required., (ii) no fees due
or pending with respect to any matter before the County Zoning Office; and (iii) no
applicable or pending application for rezoning of the Property or for a special or
conditional use permit or variance in connection with the Property. Further, no proceeding
to challenge the zoning or other governmental approval or use of the Property is pending or
overtly threatened to the best of my knowledge.
• The Property enjoys access to Shadwell Station Lane.
• Copies of any relevant records may be obtained via the noted links or the Community
Development Department Records Public Access link below. If unable to find the records, a
request may be made through the department's Records Manager, Paul Bjornsen, at
pbiornsenaa.albemarle.oro. If the request is not based in Virginia, it will take longer to fulfill.
