To Whom it May Concern:
In response to your request for a Letter of Zoning Compliance for the above -referenced
Property, please be advised of the following:
• The Property is zoned Highway Commercial ("HC"). The permitted uses of the Property are
provided in Section 24 of Chapter 18 of the Albemarle County Code (the "Zoning
Ordinance"). The Property is subject to the Entrance Corridor ("EC") Overlay District as
described in Section 30 of the Zoning Ordinance.
• The Property is not subject to any proffered conditions, approved application plan, special
use permit, or other special limitations imposed by Albemarle County, Virginia, in connection
with the Property's zoning.
The Property is subject to the approved site development plan identified as SDP201600055
Monscane Center Final (the " Approved Site Plan"). The Approved Site Plan was approved
on 05/07/2018 and is valid until 05/07/2023. The Approved Site Plan permits the use of the
Property for a commercial office building containing two floors, each floor containing 6,000
square feet, for a total of 12,000 square feet, by right, without the necessity of obtaining a
conditional or special use permit, variance, special exception or other authorization or
approval.
To the best of my knowledge, the Property is currently in compliance with all applicable
requirements of the Zoning Ordinance. A review of our files found (i) no violations or
alleged violations or regulations applicable to the Property, whether pending,
contemplated, or having already occurred, (ii) no fees due or pending with respect to
any matter before the County Zoning Office; and (iii) no pending application for
rezoning of the Property or for a special or conditional use permit or variance in
connection with the Property. Further, no proceeding to challenge the zoning or other
governmental approval or use of the Property is pending or overtly threatened to the best of
my knowledge.
• If the Property contained physical development approved with a site plan, then in the event
of casualty, the Property may be rebuilt substantially in the same form upon satisfaction of
all required building permits and site plans, as applicable.
• Pursuant to a subdivision plat identified by the County as SUB201900016, approved on
June 21, 2019 ( the " Approved Subdivision Plat'), the Property is now recognized as one or
more separate parcels of land under the subdivision ordinance of Albemarle County,

Virginia, may be conveyed, leased, or mortgaged as a separate parcel and currently
complies with such subdivision ordinance and other applicable subdivision laws. The
Property is not subject to any conditions or special limitations imposed by Albemarle County,
Virginia in connection with any subdivision approval of the Property.
• Copies of any relevant records may be obtained via the noted links or the Community
Development Department Records Public Access link below. If unable to find the records, a
request through the department's Records Manager, Paul Bjornsen, at
pbiornsen(a)albemarle.org may be made. If the request is not based in Virginia, it will take
longer to fulfill.
