This letter is to inform you that your variance application, VA-97-08, was heard during the public
hearing by the Albemarle County Board of Zoning Appeals on Tuesday, July 1, 1997. The Board
ruled(4:1)to approve your variance request with the following conditions:. The sign is a temporary
sign to be used only by this particular tenant/operator. The wording of the sign shall not change. The
sign can remain only until June 10, 1999 unless the existing State Farm sign is removed. At such
time that the State Farm sign is removed, then this sign would change from temporary to permanent.
This variance grants temporary relief from Section 4.15.12.6 of the Albemarle County Zoning
Ordinance to allow an additional freestanding sign where only one is allowed. If you have any

LOCATION: The east side of Riverbend Drive, approximately 300 feet south of its
intersection with Rt. 250
REQUEST:
The applicant seeks relief from Section 4.15.12.6, the schedule of specific requirements for signs
in the Highway Commercial and mixed commercial districts, PD-SC and PD-MC. This section
allows a maximum of 1 freestanding sign per highway right-of-way frontage for each lot with 100
feet of continuous highway frontage. There is already one sign established on this parcel
belonging to a current tenant. This request is for a second sign on the same parcel. In addition,
the applicant has stated that the existing sign will be removed ten days after the tenant's lease
expires on May 31, 1999.
The applicant's justification includes the following:
Hardship
Due to the exceptional topographic location of the building behind and below the Clean Machine
Car Wash that fronts on Rt. 250 and the nicely developed required trees in the grass area
between Riverbend Drive and parking lot, our wall sign is rendered useless as a quick way to
direct and identify our clinic for patients who urgently need our care. Patients waste time trying
to find our facility and would be greatly aided by the location of the new proposed sign. This is an
urgent care clinic and it is imperative that patients be able to easily locate the facility particularly
at times when they are anxious or in distress due to a medical condition. There have been
numerous complaints from patients unable to find the clinic.
Uniqueness of Hardship
First Med is unique to any other property on Riverbend Drive in that it is dealing with injured or sick
people that need immediate attention for their problems. This quick identification is mandatory for
the health and well being of some of these patients. The majority of other facilities in the area are
much more easily located by the public because of existing signage or distinct architectural
elements.
Impact on the Character of the Neighborhood
The proposed sign and landscaping should pose no detrimental effect to neighboring properties.
In fact, the character of the district would be enhanced by the proposed sign and will help
implement the County's comprehensive plan goal of creating an attractive and harmonious
environment.

RELEVANT HISTORY:
VA 96-01, dated 1/10/96, requested an additional 8 square feet of sign face to be added to the
existing freestanding sign. This was also for First Med but was withdrawn by the applicant prior
to hearing.
RECOMMENDATION:
Mr Smith can show that his property was acquired in good faith in 1986, but the ordinance was the
same then as it is now—one freestanding sign per parcel. There is no question of"the exceptional
narrowness, shallowness, size or shape of a specific piece of property at the time of the effective
date of this ordinance." With regards to the "development of property immediately adjacent
thereto," the adjacent property, the Clean Machine, does effect the visibility of this parcel;
however, it did so at the time of First Med's lease and therefore, is self-imposed—not any hardship
caused by our ordinance. To grant this variance would probably be considered a special privilege
or convenience for this applicant. However, It can possibly be shown to be in the interest of public
health, safety and welfare as explained by the applicant, but it is still not due to the land—only due
to the lease arrangements. For these reasons, staff finds that the strict application of the
ordinance does not produce undue hardship as allowed by the Code of Virginia.
Staff recommends denial.
1) The applicant has not provided evidence that the strict application of the ordinance
would produce undue hardship;
This appears to be a self-imposed hardship caused only by the lease arrangements made by the
owner and tenants.
2) The applicant has not provided evidence that such hardship is not shared generally
by other properties in the same zoning district and the same vicinity;
All other properties that are not corner lots in this zoning district (as well as all other zoning
districts) and this vicinity are only allowed one free-standing sign.
3) The applicant has not provided evidence that the authorization of such variance will
not be of substantial detriment to adjacent property and that the character of the
district will not be changed by the granting of the variance.
Since no zoning district in Albemarle County allows more than one freestanding sign per highway
right-of-way frontage, approval of this variance may erode the entire sign ordinance bringing many
requests for additional freestanding signs.
Although the Code does not address temporary variances, should the Board consider this as a
temporary request and find cause in the public health and safety aspect, it should be noted that
this is an emergency service and can be distinguished from other medical offices and uses where
visibility and approach time is not so critical. If a time limit is conditioned, the variance will be
eliminated once the original sign is removed and the property will again conform to the ordinance.
Should the Board find cause to approve this request, staff recommends the following condition:
1. If a First Med freestanding sign is erected, the original freestanding sign issued to Ted
Bartleski State Farm Insurance shall be removed, regardless of any lease arrangement,
before or within 10 days after May 31, 1999.
