Dear Mr. Svoboda,
As you are aware, Mr. W. A. Wells owns several abutting properties
located on Polo Grounds Road (Route 643) on which he operates his
business, W. A. Wells Excavating LLC ("Wells Excavating"). These
properties are described in Albemarle County records as Tax Map 46
Parcels 23A, 23C1, 23D and 23D1 (the "Properties"). (See Attached Parcel
Map). Mr. Wells presently processes mulch and firewood and operates his
excavating business on the Properties. On behalf of Mr. W. A. Wells, I am
submitting an application for a zoning determination that a construction
yard with offices, repair shops, storage buildings, processing and storage of
materials, and parking and storage of heavy equipment and vehicles is a
legally permitted non -conforming use on the Properties.
Such use of the Properties was established in 1964 when Southern
Materials began using the Properties for a sand and gravel excavating
business. Southern Materials excavated sand and gravel from the Rivanna
River. As part of this operation, Southern Materials operated a materials
processing plant, stockpiled materials including sand and gravel, and
parked and stored heavy construction equipment and vehicles on the
Properties. Since that time, the Properties have continuously been utilized
for these uses.
Included with the application are a set of aerial photographs which show
the Properties being continuously used in the manner described since 1966.
(See Attached). Also attached is a copy of the original contract under
which Southern Materials began operations (dated July 14, 1964) and a
listing for Southern Materials in the December 1965 Virginia Telephone &
Telegraph Company phone book.
