COMMONWEALTH OF VIRGINIA
COUNTY OF ALBEMARLE, to wit
This day before me personally appeared Elizabeth Ann Oglesby Haugh, who being duly
sworn on oath, did state and affirm the following:
1. My name is Elizabeth Ann Oglesby Haugh, and I have personal knowledge of the matters
and things set forth herein.
2. I grew up at Brookhill, 2571 Seminole Trail, now 920 Salamander Street, Charlottesville,
Virginia, which was purchased by my mother and father in 1932. At that time the
property consisted of 500+ acres, including what is now the 79.50 acre river bottom (Tax
Map 46-18C) off Polo Grounds Road near the Wells property. My father, E. J. Oglesby,
farmed that tract and it was used as a polo field for years.
3. My husband and I reside at 2575 Seminole Trail, now 960 Salamander Street,
Charlottesville, Virginia, and have since April 25,1965 (Tax Map 44 Parcel 18A). My
husband and I acquired approximately 28 acres in the center of the Brookhill land in 1960
from my mother and father. We began building a house there in May of 1964. The
property fronts on Polo Grounds Road and overlooks the river bottom. I was able to see
the plant referred to below from my house.
4. The property located at 1515 and 1537 Polo Grounds Road (now consisting of Tax Map
46 Parcels 23A, 23C1, 23D and 23131) was owned by Charlie Wells and his wife, W. A.
Wells' father and mother, and is east, down river, of our river bottom.
5. In the early 1960's Ward Delany's company set up a gravel plant on Brookhill property
near the present location of the South Rivanna Dam. When plans for a dam in that
location were announced my father and mother leased a portion of the river bottom near
the Wells property which allowed Delany's company to build a plant and take sand and
gravel from the Rivanna river beginning in 1964. I still have the onion -skin original copy
of the lease and note that I am the one that notarized my parents signature on it.
6. They did in fact build the 'plant' and take sand and gravel from the river. They also stored
and stockpiled sand, gravel, and other materials there, and parked, stored, and maintained
construction vehicles and equipment there.
7. On expiration of the lease, there were still quite large stockpiles of sand and gravel left on
our property and the adjoining properties. I understood at the time that the gravel was not
of the quality desired by the company, so they did not renew the lease nor bother to take
the existing gravel they had stockpiled with them. Under the lease that became my
parents property, and my father used the gravel left to fix up our driveway. He would use
his pickup to haul loads of gravel from the plant site up to our field, and he built up big
piles of gravel in several places along the driveway to use to fill in mudholes, etc. These
piles along the driveway would be as large as four to five feet tall. We used and restocked
the piles for years, well into the 1980's, and there was still gravel there in the 1990's long
after my fathers death.
8. They also used the Wells property for the same storage and handling of stockpiled
materials, and the parking, storing and maintenance of construction vehicles and
equipment. I don't know if this was by agreement or if they just took liberties with the
nearby land. I do know the Wells used to store and sell that gravel long after the lease
ended. It is my understanding that there is still some of the gravel from the operation on
the Wells property.
