PROPERTY OWNER: Ballif Investments LLC APPLICANT: Yadira Amarante—Dominion Development Resources. APPLICANT'S PROPOSAL: Request for major site plan amendment approval for the addition of 963 gross square feet of office space and the construction of a 12 space parking lot to accommodate the additional office space at the Dominion Development Office Park. The property, described as Tax Map 78, Parcel 15C2 is zoned Highway Commercial (HC), and is located in the Rivanna Magisterial District on South Pantops Road [Route# 1140] approximately 225 feet east of the intersection of South Pantops Road [Route# 1140] and Spotnap Road. PLANNING AND ZONING HISTORY: SDP2004-52: A preliminary site plan was approved for this property on 08/13/2004. A critical slopes waiver was approved at preliminary plan approval stage. The Albemarle County Planning Commission approved a critical slopes waiver for Dominion Office Park at a planning commission meeting held on August 10th 2004. SDP2004-91 Final Site Plan for Dominion Office Park was approved on 10/11/2005. A re-subdivision plat, boundary line adjustment and a request for final plat approval to create 2 lots on 2.377 acres were all received and approved by the Albemarle County Department of Zoning and Current Development. A bond Inspection OTH200600226 and Zoning Clearance application 200600162 were made in June and October this year. COMPREHENSIVE PLAN: The Comprehensive Plan designates this property as Community Service in Urban Area 3. REASON FOR PLANNING COMMISSION REVIEW: Approval of this application requires Planning Commission approval of a modification of Section 4.2 in order to allow disturbance of critical slopes. REVIEW OF MODIFICATION OF SECTION 4.2.3 TO ALLOW ACTIVITY ON CRITICAL SLOPES: DISCUSSION: Critical Slopes Waiver: Section 4.2.3.2 of the Zoning Ordinance restricts earth-disturbing activity on critical slopes, while Section 4.2.5.b allows the Planning Commission to waive this restriction. The applicant has submitted a request and justification for the waiver(Attachment C), and staff has analyzed this request to address the provisions of the ordinance. Description of critical slope area and proposed disturbance: The critical slope area is a wooded area that slopes down to the Rivanna River. The critical slope areas are located below and directly adjacent to the current building and parking/loading area. The proposed critical slope disturbance is for additional parking spaces to accommodate a proposed building expansion. There is very little undeveloped land on the site that is not critical slopes, so the proposal is for the lower parking spaces (7 spaces), landscaping, and stormwater structure(Filterra and rip-rap)to extend into the critical slope area. A retaining wall will be put in place behind the parking spaces to minimize grading and disturbance of critical slopes. Guardrail will be provided on the wall to provide safety. The existing water quality structure(Filterra unit)will 2 be relocated in order to provide water quality for the entire proposed parking and loading area. The critical slopes disturbed will be approximately 11%of the critical slopes on site(about 2000 square feet). Figure 1 on page 3 shows the disturbance of critical slopes: Areas Acres Total site 1.09 acres approximately Critical slopes 0.47 ac 43%of site Critical slopes disturbed 0.05 ac 11%of critical slopes Exemptions to critical slopes waivers for driveways, roads and utilities without reasonable alternative locations: This disturbance is not exempt. Compliance with Zoning Ordinance 18-4.2: "Movement of soil and rock" Proper slope construction, control of drainage, and vegetative stabilization will prevent any movement of soil. Most or all of the soil movement in areas of critical slope will be fill. It appears that the retaining wall will need to be constructed by hand, and this is the intent of the applicant. "Excessive stormwater runoff" Peak stormwater runoff rate will increase slightly(1 cfs or less for the 2 and 10 year storm). This will not be a problem downstream as the runoff will flow directly into the Rivanna River. "Siltation" An erosion control plan has not been proposed, as it is generally not required for proposed developments with less than 10,000 square feet disturbance. It will be difficult to capture any lost sediment,as the area to be constructed in is very steep. However, the amount of disturbance is very small. One available precaution is to require an erosion and sediment control plan as a condition to the critical slope waiver. (Disturbing less than 10,000 square feet does not automatically exempt someone from providing a erosion control plan,the program administrator reserves the right to consider it exempt or nonexempt.) "Loss of aesthetic resource" This area will be partly visible from the Rivanna River during the winter;however,there is not much of a change. There is already a building and loading area.The only change will be a retaining wall instead of a natural slope down from the building/loading area of the site.It appears that at a minimum three trees will need to be removed in order to put in the proposed development. The remainder of the tree buffer between the development and the Rivanna River will remain in place. The critical slopes on this site are included in the Open Space Plan (Composite Map) as part of"major and locally important stream valleys and adjacent critical slopes". Based on the inclusion of these slopes in the Open Space Plan, staff views the disturbance of these slopes as a potential loss of aesthetic resources. "Septic effluent" This project is serviced by public sewer.No septic systems or drainfields are proposed in this project. Based on the review above, there are no engineering concerns that prohibit the disturbance of the critical slopes as shown. 3 Section 4.2.5(b): Staff has included the provisions of Section 4.2.5b here(in italics), along with staff comment on the various provisions: b. The commission may modify or waive any requirement of section 4.2 in a particular case upon finding that: (Amended 11-15-89) 1. Strict application of the requirements of section 4.2 would not forward the purposes of this chapter or otherwise serve the public health, safety or welfare, or that alternatives proposed by the developer would satisfy the purposes of section 4.2 to at least an equivalent degree; or(Added 11-15-89) There are no proposed alternatives presented by the developer that would satisfy the purpose of section 4.2 to at least an equivalent degree. However, a retaining wall will be put in place behind the parking spaces to minimize grading and disturbance of critical slopes. 2. Due to its unusual size, topography, shape of the property, location of the property or other unusual conditions, excluding the proprietary interest of the developer, the requirements of section 4.2 would effectively prohibit or unreasonably restrict the use of the property or would result in significant degradation of the site or adjacent properties. Such modification or waiver shall not be detrimental to the public health, safety or welfare, to the orderly development of the area, or to adjacent properties, or be contrary to sound engineering practices; or(Added 11-15-89) There property is already in use with an office building having already been constructed; therefore, the requirements of section 4.2 do not effectively prohibit or unreasonably restrict the use of the property. 3. Granting such modification or waiver would serve a public purpose of greater import than would be served by strict application of section 4.2. (Added 11-15-89) There are no immediately identifiable reasons that would be considered of greater import. RECOMMENDATION: Based on the analysis of the Open Space and Critical Resources Plan and on the review of the engineering criteria presented above, staff opinion is that this request does not meet the criteria for approval. Should the Planning Commission choose to approve this request, staff recommends the following condition: 1)The site plan amendment shall not be signed until an Erosion and Sediment Control plan has been approved. 4 Attachments: A - Tax Map/Location Maps B - Site Plan C - Applicant's Request and Justification D- Pictures. The attached site plan shows that there are areas with 25% or greater slopes that will have to be disturbed as part of this road project. The total area of existing critical slopes on TMP 78-15C2 is 18,252 SF. The total area of critical slopes that will be disturbed for the parking lot expansion and associated stormwater management facilities is 1,624 (9 percent). "movement of soil and rock" We will provide an erosion and sediment control plan for controlling the movement of soil and rock involved with the construction proposed in the critical slopes. We will provided information concerning how the stormwater runoff will be controlled by the drainage and stormwater management plan proposed for this project. 3. "siltation of natural and man-made bodies of water": Inspection and bonding by the County will ensure siltation control during construction Proper stabilization and maintenance will ensure long term stability. 4. "loss of aesthetic resource": The existing critical slopes proposed for disturbance are delineated on the Open Space Plan Composite Map for Neighborhood 3 and are located within a Major or Locally Important Stream Valley — the Rivanna River River and stream valleys are designated as important resources that are often associated with critical slopes. Although disturbance of these slopes is minimal it will be further mitigated by erosion control measures minimizing the chance of erosion on the downhill slopes approaching the flood plain and river. Also, a tree conservation measures and the applicant's contribution to The Greenway by means of a dedicated easement further protect this important aesthetic resource. 5. "septic effluent": No septic systems or drainfields are proposed in this project. This project will be served by the public sanitary sewer system. This site does not drain into a waterway that is a public drinking water supply for Albemarle County. The most southern portion of TMP 78-15C2 is shown within the 100- year flood plain area according to FEMA Map 51003CO287D, dated 04 February 2005. The reasons given above demonstrate that the grading of critical slopes on this project will not be detrimental to the health, safety, and/or welfare of the public.
