Dear Ms. McCulley:
Enclosed is the authorization from Star Enterprises for Tiger Fuel Company to
apply for the above captioned special use permit. Also enclosed is a copy of the most
recent approved recorded plat for the property. A much more detailed and informative
plat has been filed with the Department of Planning and Community Development as part
of our site plan submittal. If you desire additional copies of that plat please let me know.
Currently in the fast food industry in excess of fifty percent of all sales dollars are
being made through drive-through windows. This trend is becoming stronger every year
as the consumer continues to demand faster and more convenient service. It is an
economic necessity for a fast food restaurant to have a drive through window in today's
competitive environment in order to survive. Wendy's, the proposed user of this parcel,
continues to respond to this trend by reducing the seating and parking for its location
and increasing the convenience of the drive-through window. This drive in window is
even more important in this type of application where it is a joint venture between a fast
food restaurant and a retail gasoline facility. Our research shows the retail gasoline
customer is much more inclined to use the drive-through window rather than dine in the
sit down restaurant.

This property comfortably accommodates a drive-through window without any
negative impacts to the traffic flow internally or externally from the property. For these
reasons it is requested that the zoning and planning departments grant this request for

Company to apply for permits and related zoning matters on the parcel of property owned
by Star Enterprise at the intersection of U.S. 250 and Rt. 20 in Charlottesville, Virginia.
Mr. Sutton and Tiger Fuel have a contract for the purchase of this property from Star
Enterprise.
