Dear Archie D. & Richard A. Rohm,
This is to further clarify the proposed Rohm subdivision.
Mildred Rohm called on January 24th and 28th, and Bill Sullivan
on January 25th, to determine where the subdivision plat is along
the process of approval. Let me reiterate some of the memorandum
dated December 26, 1984 (attached) .
This subdivision plat was included with those that were to
be reviewed by the Planning Commission. Later it was discovered
through discussion with Morris Foster, that this is a FAMILY DIVISION.
Therefore, it does not need to go to the Planning Commission un-
less the applicant wishes relief from any of the requirements. If
the applicant does not plan to request a waiver from the require-
ments, the following conditions must be met, and the plat may be
signed. Once a member of Planning staff signs the plat, it must
be recorded to create these as legal lots.
REQUIREMENTS FOR FAMILY DIVISIONS : the single division of a lot
or parcel for the purpose of sale or gift to a member of the immedi-
ate family (the natural or legally defined offspring , spouse or
parent) of the owner of a lot or parcel of land, provided that:
a. Only one such division per family member;
b. No further division of such parcel except in accordance
with Subdivision Ordinance;
c. Parcel cannot be transferred for one year;
d. If parcel is transferred to adjacent owner then it must
become part of adjacent existing tract;
e. If private road family division, then requirements of
Section 18-36 (a) and Section 18-36 (d) apply. (See
proceeding comments) .

f. All parcels created by such a division shall conform
to the Zoning Ordinance;
g. Entrance onto public road must comply with requirement
of Virginia Department of Highways and Transportation.

FAMILY DIVISION ON PRIVATE ROAD IS SUBJECT TO:

o Section 18-36 (a) - Private roads are considered an excep-
tion to the construction of public roads . Approval is
discretionary. If staff has a problem with a particular
private road, staff is not obliged to approve it, but may
take it to the Planning Commission for review. Any further
subdivision on such road shall require subdivision approval.
Not more than one (1) dwelling per parcel.
o Section 18-36 (d) :
1) Road must be adequate to carry expected traffic;
2) Comprehensive Plan does not provide for a public road
in that location;
3) Fee of road to be owned by abutting lot owners or
association of lot owners, subject to an easement;
4) Road not designed to serve through traffic nor to
intersect State road in more than one location.
o Section 18-36 (e) (1) - States that there are no minimum
standards for private roads under Section 18-36 (b) (5)
(Family Division) except as required under Section 18-36 (d) :
the road must be adequate to carry expected traffic. The
County Engineer will determine if the road as proposed is
adequate and he may require a construction bond.
o Maintenance agreement is required for private roads, family
divisions. (This maintenance agreement must be drawn up
by an attorney, and is reviewed by Fred Payne, Assistant
County Attorney) .
In summary, the Planning Department must receive approvals for
the aforementioned from the County Engineer, the Assistant County
Attorney and the Virginia Department of Highways and Transportation.
Once all approvals have been submitted, and the plat includes all
the required technical information, it will receive final approval
and be signed.
