The Health Department has commented that no expansion is necessary at this time and that there is adequate area for alternate • drainfields if the Commission allows their continued use. Staff has received verbal preliminary approval of the drainage plans from the County Engineer's office. We have alsoreceived preliminary approval from the Fire Marshall on the relocation of the natural gas tanks. This plan will meet the requirements of the zoning Ordinance and Staff recommends approval with the following conditions : RECOMMENDED CONDITIONS OF APPROVAL: 1 . Building permits for the new uses will be processed when the following conditions have been met by the applicant: a. The work must be completed or a new bond posted on the improvements shown on the previously approved plan; b. Zoning Administrator review and approval of the grading and drainage amendments (as referenced in the Highway Department's comments dates February 4, 1982) in compliance with Article 4.3 of the Zoning Ordinance. 2. The applicant shall connect to public sewer when either of the existing septic systems or drainfields fail and/or additional use of property requires expansion of systems or drainfields. 3. Access to this site shall only be allowed via the entrance approved by the Virginia Departn �nt of Highways & Transportation. STAFF REPORT: MATT/STUTZMAN FINAL PLAT: Location: Parcel 10F(2) , tax map 66, Rivanna District; located off the north side of Rt. 22, on a private road northwest of Cobham. Acreage: 7.86 acres. Zoning: RA, Rural Areas. History: The plat creating this parcel was signed in March, 1974. Proposal : To divide a 3.93 acre parcel leaving 3.93 acres in residue. Reason for Planning Commission Review: The parcels are served by a private road. Topography of Area: Condition of Roads Serving Proposal : This section of Rt. 22 carries 1 ,355 vehicle trips per day. Watershed Impoundment: N/A STAFF REPORT: PLANNING COMMISSION MEETING: FEBRUARY 23, 1982 - Page 13 Soils: N/A Comprehensive Plan Recommendation: This site is located within the "other rural" land designation with a recommended density of one unit per two acres. School Impact: N/A Type Utilities: N/A Staff Comment: When the Staff initially talked to the applicant, it was our understanding that the 3.93 acres would be added to and become part of the applicant' s adjacent lot. This division would be basically exempt except that the residue would be less than 5 acres. Since no new parcels were to be created, Staff scheduled this item for the Commission ' s review. However, the plat shows the divided parcel as being a separate parcel . When this was pointed out to the applicant, he explained that he couldn' t join the two parcels because they are being financed separately. He explained that he is buying the property for protection and does not intend to build on it. Therefore, he is requesting that the Planning Commission approve this plat with a note that no building permits be issued on the 3.93 acre parcel , Lot E-1 , without Planning Commission approval . Staff has not completed an extensive review of this plat since it did not go through the regular process. If the Commission does not approve this request, Staff will conduct the normal review and bring the plat back to the Commission in March. It should be pointed out that the Zoning Administrator feels that plats with this type of note are sometimes difficult to enforce. The applicant' s wish was that the Staff bring this request to the Commission for the aforementioned reasons. Should the Commission choose to approve the request, Staff recommends the following conditions: RECOMMENDED CONDITIONS OF APPROVAL: 1 . The plat will be signed when the following conditions have been met by the applicant: a. Note on the plat: "No building permit will be processed or issued on Lot E-1 without Planning Commission approval ;" b. Correct the tax map parcel to lOF(2) .
