Roudabush, Inc. There was a provision that I gave up all other development rights on the balance of parcel's 1C and 1A. I did not know by signing this plat, I also gave up family provision rights. The plat signed by the County of Albemarle Planning Department on 4/17/84, stating that division rights were waived on tax map 102,parcels 1C and 1(A)1 was signed in error. The note on the plat should have referred to tax map 102,parcels 1C and 1A. Because of this error it was the County attorney's opinion that you have the right to subdivide the 5-acre tract known as tax map 102, parcel 1 A and that the note would still apply to parcel 1C. Theoretically you have one (1) division right remaining on parcel 1A. Please be advised that this determination of division rights is theoretical only. It is based on the assumption that the properties have no prior division history, no special use permit or Zoning Map amendment restrictions, and that they have not been developed. In order to utilize these development rights you must meet all of the appropriate County regulations, i.e. Zoning Ordinance, Subdivision Ordinance, etc. If you have any questions please do not hesitate to call me at (804) 296-5823 ext. 3297.
