CHECKLIST FOR EXEMPTION FROM PROVISIONS OF THE SUBDIVISION ORDINANCE
A. All parcels as a result of such subdivision shall be 5 acres or greater and have a minimum of 250'of state road frontage.
OR
B. The sale and/or exchange of land between adjoining landowners;provided,that:
❑ The land so sold and/or exchanged shall be added to and become part of an existing adjacent parcel as evidenced by
appropriate symbol and wording on the plat together with signatures of both landowners pursuant to Section 18-55(b)
and by the instrument of conveyance thereof;AND
❑ No parcel which was five acres or greater in area prior to such sale and/or exchange shall, as a result of such sale
and/or exchange,be less than five acres in area;AND
❑ No parcel shall,as a result of such sale and/or exchange,front less than two hundred fifty feet on a road which is part
of the state highway system or state secondary highway system;AND
❑ No additional lot or parcel shall be created by such sale and/or exchange.

`• (2) Plans shoving the design, material, exterior color scheme,
grading plans, location on the lot, and type of oahat,uction of any house,
residence or other building, or alterations or additions thereto, shall, be-
fore the beginning of any work thereon be submitted to William C. Smith for
approval. The said William C. bm1th may approve or disapprove of said plans
within thirty days from the data raid plans are submitted to him. If said
plans are not disapproved within thirty days from the date they are submitted
to the said William C. Smith, they Are conclusively presumed to have been
approved. In the event of disapproval of said plans by the said William C.'
Smith, the builder submitting said plans may submit said plans to a committee
composed of three members, one of whom is to be selected by the said William
C. Smith, the second by the builder, and the third to be a practicing archi-
tect in the City of Charlottesville selected by the two members selected as
aforesaid, and the decision of a majority of the members of said committee
shall be final. All expenses of such committee shall be borne by the builder
submitting said plans.
(3) If no legal action with respect•to a violation of the restric
tion set out in paragraph (2) above shall have been commenced and no notice
of lis pendens with respect thereto is recorded in the Clerk's Office of the
County in which said lots are situated within 60 days after completion of •
such home, residence or other building, or alterations or additions thereo,
it shall be conclusively presumed that there has been full compliance with
said restriction.
(1,) No lot shall be further subdivided.
(5) Any building erected on any lot shall be so located that no
portion thereof shall be within 35 feet of the road or street upon which it
faces and in respect to the lake front lots, the building shall be so located
so that no portion thereof shall be within 35 feet of the water's edge of the

(6) No residence or dwelling house shall be erected or kept on '
qay lot costing less than 14,000.00, exclusive of architectural and legal fees
landscaping, grading and driveways.
(7) No signboards or advertising posters are to be permitted ex-
cept signs or notices which may offer the property for sale or for rent.
(8) No nuisance shall be maintained on said lots.
(9) William C. Smith reserves for himself, his heirs and assigns,
a permanent easement across the rear and side lines of each lot within five
feet of the boundary for the installation of utilities or sewerage or drainag.

(10) None of the said lots shall be used for a roadway or access
to any property lying outside the boundaries of "Sandy Branch Resort Farms"
Subdivision unless the said William C. Smith shall give written consent to
such use of the said lots.
(11) Each of the owners of the several lots in this subdivision
shall have the non-exclusive right to use the streets and roads as shown on
said plat together with William C. Smith and each of the said lot owners and

The expenses of maintenance and repairs to the overflow pipe in
the lake, the dam and the overflow pipe leading from the dam through the
"Reserved" area as shown on said plat, shall be paid for by the said William
C. Smith and each lot owner in the same proportions as in the above'paragraph
William C. Smith, owner, his heirs and assigns, G. Benton Patterso ,
his heirs and assigns, the owner of Lot 3, Block B, and Allan N. Spitzer, his
heirs and assigns, the owner of Lot 4, Block B, of said Subdivision, shall be
a committee who shall have the right and the power to make the decisions when
repairs and maintenance are necessary and require for the said streets and
roads, the dam, the overflow pipes and their decisions shall be final as to
the necessity of said repairs and maintenance. The •sald committee shall have
the power and authority to take all steps necessary to have the repairs and
maintenance done, including the right to. hire the necessary persons and the
right to order the necessary materials and equipment and each lot owner shall 'II be responsible for his proportionate share of the costs of the said labor
and materials as stated above.
(12) Each owner of the several lots in said subdivision, together
with the said William C. Smith, shall have the nonexclusive right to use the
lake located on the said property and 'as shown on said plat, which right and
use of the said lake shall be restricted to the owners of the said 15 lots
and the said William C. Smith and no other person or persons shall be granted
such right or use. All owners of lots that do not front on the said lake,
which are lots 1-7, .both inclusive in Block A and Lot 1, Block C, as shown
on the said plat,

(13) The term "William C. Smith, his heirs and assigns," as used
in these restriction covenants, shall be taken to mean William C. Smith and
any successor to his interests as subdivider, and shall not be construed to
