The drain field has no reserve area. I request permission to construct a two bedroom house to replace the existing mobile home. If this request is granted I will obtain an easement from the adjoining property owners which will provide for a 50% reserve area for the drain field. Justification: 1. It appears to me that the inability to replace a two bedroom mobile home with a two bedroom house causes an undue hardship. 2. The adjoining property was recently granted a variance allowing for the installation of a drain field with only a 50°A) reserve area. 3. There are no other mobile homes in the neighborhood. The houses in the neighborhood are upscale. Granting the variance would allow for construction of a house more in line with the adjacent development. The existing mobile home detracts from the adjacent property value. A house on the property would increase the value of the adjacent property. Your inquiry was about County regulations for residential sewage disposal on a lot in Lake Albemarle, tax map 41A, parcel 111. As I understand it, this lot is approximately 1/3 acre in size and is built with a mobile home. Section 6.4.1, "Nonconformities", permits replacement of the existing mobile home with another mobile home. This section specifically, "exempts" mobile home replacements from compliance with regulations such as that for septic systems. It states in part, "nothing in this section shall prohibit the replacement of a nonconforming mobile home . . . provided the mobile home is labeled to indicate compliance with either the Virginia Industrialized Building and Mobile Home Safety Regulations or with the Federal Manufactured Home Construction and Safety Standards..." In any other proposal, regardless of the number of bedrooms, compliance with Section 4.1.6 is required. This section requires Health Department approval of a primary and reserve area septic disposal field to accommodate sewage disposal for a 3-bedroom dwelling. A variance is necessary even if construction of a 2-bedroom house is proposed. As I have mentioned, the location of this property in a watershed in close proximity to a public lake, generates the need for careful and deliberate thought for the construction of a house and septic disposal.
