TM41A/P111, zoned Rural Areas. Applicant requests two variances: to
decrease the size of the original septic disposal field to allow a two-
bedroom sized field, and to decrease the size of the future replacement
septic disposal drainfield to allow a 50% reserve. The variance is to
allow an existing mobile home to be replaced with a new home of the same

1) That the strict application of this ordinance would produce
undue hardship.
2) That such hardship is not shared generally by other properties
in the same zoning district and the same vicinity.

THIS TRUSTEE'S DEED made this 3rd day of June, 1996, by and
between JAMES M. BOWLING, IV, Trustee, Grantor; and THOMAS A.
WARBY, additional 3rantor, and CAROLYN MARINEL, unmarried, Grantee,
whose address is 10175 Glebe Road, Orange, Virginia 22960.
W I T N E S S E T H :
WHEREAS, Trudy M. Anderson ("Borrower"), by certain deed of
trust dated April 5, 1993, recorded in Deed Book 1299, Page 32,
among the land records of the County of Albemarle, Virginia, (the
"Deed of Trust"); granted and conveyed James M. Bowling, IV,
("Trustee"), all of the hereafter described property in the Deed of
Trust to secure a debt to Tape Rental Library, Inc. Pension Plan
and Trust in the original principal amount of $8,000.00, (hereafter
the "Obligation"); and
WHEREAS, the Trustee, by the terms of the Deed of Trust, was
empowered, upon default in the payment of the debt referred in the
Deed of Trust, and upon request of the Beneficiary of the Deed of
Trust to do so, to sell the hereafter described land at public
auction; and
WHEREAS, default was made in the payment of the debt and the
Beneficiary requested that the Trustee sell the land pursuant to
the terms of the Deed of Trust; and
111 WHEREAS, the Trustee did advertise the time, place and terms
of such sale in the Daily Progress, a newspaper having general
circulation in the County of Albemarle, Virginia, in the issues of
April 6, 13, 20 and 27, 1996, the date of sale being fixed in this
notice for May 1, 1996 at 12:00 Noon at the front steps of the

Circuit Courthouse building for the Count of Albemarle, Virginia;
and
WHEREAS, the Trustee gave written notice of the proposed sale
by certified mail to Francis G. Gordon, the owner of the property
at the time of the sale, and to Trudy M. Anderson, to their last
known address, with a copy of the advertisement enclosed, at least
fourteen (14) days prior to the date of sale; and
WHEREAS, the Trustee at the time and place of the sale did
expose the hereafter described property to sale at public auction
to the highest bidder, for cash, in strict accordance with the
terms of the Deed of Trust, at which sale Thomas A. Warby, who has
assigned his rights to the Grantee,became the purchaser thereof for
the sum of Fourteen Thousand Seven Hundred Sixty-one Dollars
($14,761.00), that being the last and highest bid; and
WHEREAS, the purchase price has been paid in full by the
Grantee, as hereafter described;
NOW THEREFORE, in consideration of the premises and the sum of
• Fourteen Thousand, Seven Hundred Sixty-one ($14,761.00), which is
evidenced by credit for partial payment of a note dated April 5,
1993, in the original principal amount of Eight Thousand Dollars
($8,000.00), at and before the sealing and delivery of this Deed,
receipt of which is hereby acknowledged, which sums are to be
appropriated and applied as provided by law, the Trustee does
hereby GRANT and CONVEY unto the Grantee with SPECIAL WARRANTY OF
TITLE, the following described property, to-wits

the aforesaid Clerk's office in Deed Book 1367, page
50;
BEING the same property in all respects as conveyed to
James M. Bowling,
IV, Trustee, by deed of trust dated
'}: April 5, 1993 of record in said Clerk's Office in Deed
m. . Book 1299, page 32.
This conveyance is made subject to any and all easements,
restrictions, teeervations and conditions contained in duly
recorded deeds, plats and other instruments constituting
constructive notice in the chain of title to the above-described
property which have not expired by time limitation contained
therein or otherwise have become ineffective.
1 Thomas A. Werby joins herein to ASSIGN all his rights as
purchaser to Carolyn Marinel and directs that the property be _
conveyed to her.
