TAX MAP/PARCEL: 45/112G ZONING: C-1 Commercial ACREAGE: 4.834 Acres LOCATION: Located on the east side of Berkmar Extended,just north of the intersection of Woodbrook Drive and Berkmar Extended. REQUEST: The applicant requests relief from Section 4.15.12.5 of the Albemarle County Zoning Ordinance which states: "Wall signs, maximum height 20 feet". The applicant seeks a variance to increase the height of a wall sign from twenty (20) to twenty- eight (28) feet. The request is for a seventy-one and four tenths (71.40) square foot blue channel letter sign. The sign size compiles with the ordinance requirements. The applicant's justification for the variance includes the following: Hardship "As you can see from the enclosed front elevation, our AdventureLand sign would not fit at a lower height due to glass below, and would be too long for the opposite side. The electrical is complete to the sign. Also, this 28 foot height will be more visible from Berkmar Drive Ext., and will be more aesthetically pleasing, and enhance building front." Uniqueness of Hardship "Apparently, there are other non-conforming business signs in the area to include Rio Hill Shopping Center and Fashion Square Mall." Character of the Area "There would be no change to the character of the district nor determent to other commercial lots near our Family Fun Park." AdventureLand, L.C. VA-96-07 June 17, 1996 page 1 RELEVANT HISTORY The Shoppers World shopping center has been granted a number of variances beginning in October 1992 to increase the wall signs to a 30 foot limitation. These include T.J.'s, Advance Auto, and Staples. In April of 1993 the Kroger sign allowing a 30 foot height limit was approved in the Rio Hills Shopping Center. In November of 1995, the Qual-Choice sign variance was approved to increase the height to 28 feet. Please keep in mind that the variances are not precedent setting. RECOMMENDATION The proposed building measures thirty (30) feet in height to the top of the cornice. The placement of the sign as proposed at twenty-eight feet is not inconsistent with the height of signs that have been approved on many other large scale buildings in the area. The sign will not be an anomaly. The applicant proposes painting the building an off-white (toward the brown range of colors) with off-white trim (a darker brown range). The blue channel letter sign with black return, is proposed to measure 71.40 square feet. The combination of colors and the height will not cause the sign to be the predominant feature on the building, it should be visible but not incongruous enough to be a detriment to the site. The property owner has not shown that his property is by reason of the exceptional narrowness, shallowness, size or shape of this specific piece of property at the time of the effective date of this ordinance, or by reason of exceptional topographic conditions or other extraordinary situation or condition of this property or the use or development of property immediately adjacent thereto, the strict application of the terms of this ordinance would effectively prohibit or unreasonably restrict the use of the property or that the granting of such variance will alleviate a clearly demonstrable hardship approaching confiscation, as distinguished from a special privilege or convenience sought by the applicant, provided that all variances shall be in harmony with the intended spirit and purpose of this ordinance. Staff recommends denial for cause: Nc4- 1) The applicant'ias provided evidence that the strict application of the ordinance would produce undue hardship; The applicant has not produced evidence regarding any exceptional conditions or extraordinary situation or condition of the property that would unreasonably restrict the application of the terms of the zoning ordinance. VA-96-07 June 17, 1996 page 2 took 2) The applicant ha irovided evidence that such hardship is not shared generally by other properties in the same zoning district and the same vicinity; Currently, wall signs in the Rio Hills Shopping Center, Shoppers World Shopping Center, and sites along Route 29N all have signs above the twenty (20) foot height limitation. Variances have been approved which have allowed for a ten foot variance from the twenty foot allowed by right, for signs up to 30 scare feet in height.. 3) The applicant has provided evidence that the authorization of such variance will not be of substantial detriment to adjacent property and that the character of the district will not be changed by the granting of the variance. The location, color and placement of the proposed sign will not create an anomaly within this district. The scale of the building and the design features on the building (this includes window treatment and entrance design) help dictate where the most reasonable placement for the sign, without creating any dissonance on the building. To authorize upon appeal or original application in specific cases such variance from the terms of this ordinance as will not be contrary to the public interest, when owing to special conditions a literal enforcement of the provision will result in unnecessary hardship; provided that the spirit of the ordinance shall be observed and substantial justice done , as follows : When a -property owner can show that his property was acquired in good faith and where , by reason of the excep- ti,onal narrowness , shallowness , size or shape of a specific piece of property at the time of the effective date of this ordinance , or where , by reason of exceptional topographic conditions or other extraordinary situationorcondition of 71_ such piece of property,; or of the use or development of -property immediately- adjacent thereto , the strict applic- ation of the terms of this ordinance would effectively prohibit or unreasonably restrict the use of the property or where the board is satisfied, upon the evidence heard by it , that the granting of such variance will alleviate a clearly demonstrable hardship approaching confiscation, as distin- guished from a special privilege or convenience sought by the applicant, provided that all variances shall be in harmony with the intended spirit and purpose of this ordi- nance . ' No such variance shall be authorized by the board of zoning appeals unless it finds : ( a) that the strict application of this ordinance would produce undue hardship ; ( b) that such hardship is not shared generally by other properties in the same zoning district and the same vicinity; and ( c ) that the authorization of such variance will not be of substantial detriment to adjacent property and that the character of the district will not be changed by the granting of the variance . No such variance shall be authorized except after notice and hearing as required by section 15 . 1-431 of the Code . No variance shall be authorized unless the board of zoning appeals finds that the condition or situation of the prop- erty concerned or the intended use of the property is not of so general or recurring a nature as to make reasonably practicable the formulation of a general regulation to be adopted as an amendment to the ordinance .
