In 1860 an acre and one half of land was purchased from John Early and the original building was disassembled and reconstructed on the new land, where it is presently situated. At the turn of the century an additional 3+ acres was purchased adjacent to the church for the purpose of constructing a Rectory as a residence for the minister. Then,in the early thirties,a building was moved from Zion's Crossroad to the church property to serve as a parish hall. These three structure constitute the church's real estate holdings. Over the years customs have changed and many clergy are provided with a housing allowance in lieu of a church-owned house. Further,over the years the Rectory has not served its original purpose and has been a source of constant concern to the parish. As a small country church, we do not have a full-time minister for the parish. Most recently we have been renting the property and our tenants, due to the nature and condition of the house,have presented an even greater source of concern. Therefore, the church,recognizing that it is not in the real estate business, voted to divest itself of the Rectory and seeks to subdivide the property so that the building can be sold as a normal residential piece of property. We are requesting that a variance be granted so that the Rectory may be sold on a one acre plot of land as opposed to the sixty thousand square foot zoning requirement (Ehhibit A). Justification based on three criteria 1) Undue hardship: A review of the accompanying plat (Exhibit B)illustrates how a sixty thousand square foot plot would be configured. In essence, the land behind the Parish Hall would become part of the former Rectory plot. This land, adjacent to the building,is currently used for parking for the parish hall for church functions and other group usage including AA,adult literacy,the community civic association and a variety of other activities;for outdoor Sunday School activities, as play space for community groups that we freely let use our buildings including the Cub Scouts,Boy Scouts and others. We maintain an extensive green belt along the eastern side of our property which protects the residents in Earlysville Heights. The loss of the land would necessitate our clearing the woods to create compensatory space. Within this area is an outdoor altar/chapel built sometime in the 1920's. The creation of a sixty thousand square foot lot, as opposed to one acre,necessitates a higher selling price which,in all probability,prices the building out of the range of the first-time home owner or other likely purchaser. The condition of the house and the work needed will require additional expenditures. 2) Hardships not shared with other properties: The uniqueness of our property and of its usage precludes other properties from sharing the same hardships. Adjacent properties to our south, east and north are residential pieces of land, generally less than an acre in size, and part of well established neighborhoods. To the west, across Route 743, are some older homes and the Earlysville Animal Hospital. All the activities taking place in this vicinity are of a different nature than the church and community activities taking place on our property. 3) Variance will not be substantial detriment to adjacent property: Historically, the Rectory has existed as an extant plot on the northern portion of Buck Mountain's property. In fact, it is identified by the county as a separate parcel (35A1) consisting of one acre, though never officially subdivided. The proposed property line merely establishes the de facto line that through nearly one hundred years of usage has existed. The character of the district will not be changed in any manner whatsoever because what we are requesting is that which currently exists.
