Timothy Beeghly, landowner Date: June 13, 1996 Re: Variance for a three bedroom Reserve Drainfield In early 1994 I purchased in good faith, approximately 6 acres of land in Esmont, Virginia. Later that summer a small strip of land was perked for a 4 bedroom homesite with the septic and reserve stacked in the front yard and the well in the rear yard. During the excavation in October, the house had to be moved towards the western property line approximately 30 feet due to encountering bedrock; with almost 6 acres of land and all of my neighbors having working drainfields, no one felt this would present a problem. Because of an unusually hard winter, there were many construction delays and I was unable to finish the house by the time my original septic permit expired in March of this year. In reapplication, a primary site was approved however I was told I needed to perk for a reserve field. Unfortunately due to the extreme topography of my land (sloping with a stream) and the fact that my soil has a high shale content, combined with the slight movement of the house, we have been unable to find a site that meets the zoning requirements . We did however find a • site that perks between 50 -60% . In an effort to find a site that meets the County' s requirements I have approached both of my neighbors regarding an easement. When this approach failed I offered to buy the land and again my offers were refused. I have hired a private soil consultant, Mr. Dave Grant who performed numerous perk tests . We have also completed over 20 loader tests . I have spent many hours and dollars attempting to meet the county' s requirements; still, I have been unsuccessful . At this point I have spent over $200, 000 on a home greatly improving the value of my lot and helping to improve the quality of homes in Esmont and hopefully assisting in the increase of surrounding property values . Without this variance I will be unable to get my needed occupancy permit creating undue financial hardship and my home and land will be seized. The abandonment of this home would not only be a demonstrable hardship for my family but could subsequently create a decrease in my neighbors property values as well .
