VA 97-12 . (Sign #3) First Gold Leaf Land Trust, Owner and
Albemarle County Service Authority, applicant. Located on the
east side of Rt. 29, approximately 1300 feet north of its
intersection with Woodbrook Drive. Tax map 45, parcel 111,
zoned HC, Highway Commercial. Request to reduce setback from 50
feet Lc) 20 feet of an adjacent residential property line to allow
constriction of a new replacement wastewater pump station. \qlr\
DESCRIPTION OF REQUEST: To allow construction of a wastewater
pump station within 50 ft . of the common property line between
HO and residential zoning. The proposed station will eliminate
an existing station on the residential property in favor of one
located in the Highway Commercial tract . The relocated station
will allow vehicular access precluded on its current site .
JUSTIFICATION SHALL BE BASED ON THESE THREE (3) CRITERIA:
1) That the strict application of this ordinance would produce
undue hardship.
The location of the station is restricted by topography . Shifting - '.
the station away from the property line will significantly increase
its construction cost'depth . As located, the station will require
a minimum "take" from the existing parcel for public use .
2) That such hardship is not shared generally by other properties
in the same zoning district and the same vicinity.
The station would be allowed on the adjacent residential tract with
a minimum setback requirement . It is a public facility that will
be used by both the residential and commercial properties .
3) That the authorization of such variance will not be of
substantial detriment to adjacent property and that the
character of the district will not be changed by the granting
of the variance.
Construction of the new station will enhance the adjoining residential
property by eliminating a station prone to problems . It will also
provide public service to undeveloped property within the basin .
The application may be deferred by the staff or the Board of
Zoning Appeals, if sufficient information necessary to this review
has not be submitted by the deadline.
