Dear Mr. Robertson:
In a conversation held 25 April 1996 with your representative, Mr. Bruce Locker, I
explained that the reason the construction of your addition had been stopped by the County of
Albemarle. Provided herein is a summary of this explanation, additional improvements that must
be constructed with the addition, and the condition that must be satisfied before issuance of a
certificate of occupancy.
The existing structure and the imposed addition are approximately 135-feet from the
South Fork Rivanna Reservoir. Therefore, any development on this property must meet the
provisions of our Runoff Control Ordinance. All of the existing and proposed structures and most
of the property are within the 200-foot building and septic system setback from the 100-year
flood ain M of the Reservoir This setback-1a was not reflected on the information submitted with
the building permit application and was unfortunately overlooked by County staff when the
building permit was approved. During a footing inspection, the setback violation was identified.
Subsequently, construction of the addition was stopped and this Department notified.
The construction of buildings and septic systems within the setback is not permitted by the
ordinance. However, rovision are made for exce tions on lots that were created before the
ordinance was adoted. In these rare cases, we historical! havepermitted a tttons working
with the applicant tpreserve the integrity of the setback b minimizin l 4urther eq Loacments
and provt (jjig reasona1iTe controls on the discharges of stormwater runoff`. Your parcel�
was
created prior to the ordinance and is therefore within this category.
The proposed addition reduces the separation between the building and the reservoir by
approximately 20-fbct. Based on our review, it would not be sensible to alter the position of the
addition. However, we may permit the construction provided that the runoff from the structure is
controlled by piping the downspouts to "seepage trenches". The attached sketch shows the roof

areas that need to be controlled and the length of seepage trench that must be installed. The
specifications and details for the "seepage trench" are also attached. Before construction of the
addition may commence, a "Runoff Control Alternative Agreement" (see attached) must be
signed by either the applicant, the applicant's representative, or contractor. Please note that prior
to issuance of a certificate of occupancy, the "seepage trenches" must be installed by the
applicant/contractor and inspected by the Department of Engineering.

RUNOFF CONTROL ALTERNATIVE
FOR SINGLE FAMILY DWELLINGS
SPECIFICATIONS
The runoff control alternative described here consists of
seepage ditches connected to rain gutter downspouts . Each ,
downspout,•wi1l require a separate seepage ditch , the length of
which to be determined by its corresponding roof drainage area .
The required length of ditch is taken from Table I . For
downspouts with roof drainage areas of less than 500 square feet ,
the required ditch length should be calculated at 4 feet for every
100 square feet of roof area . The runoff from 2 or more
downspouts may be collected and then flow into a single seepage
ditch whose length is determined by the sum of the roof drainage
areas served by the downspouts. .
Figure 1 shows the cross section and side view of the seepage
ditch . The downspout should be equipped with a method to convey
overflow, and a splash block or some other means to dissipate its
energy. Drain pipe installed . in ditch sections sloping downhill
should be equipped with a plug in the end . It is recommended that
ditch slopes in excess .of 5% be avoided where possible to prevent
piping . Seepage ditches should be installed no closer than 10
horizontal feet from septic drainfield locations. Seepage ditches
should not be located uphill of septic drainfields .
These specifications are not intended to discourage the use
of other pipe sizes or ditch configurations which would provide
equal or better runoff control . Any request to. make use of
differing specifications will be considered on an individual
basis, and should be submitted with the Runoff Control Alternative
Agreement Form to the Albemarle County Department of Engineering .
