variance of density to allow 0.869 acres with three existing dwellings to subdivide into two
parcels Property zoned Residential 2, which requires 0.5 acres per dwelling. The proposed lot
for the two dwellings would need 1 acre and consists of 0 48 acres, requiring a variance of 0.52
acres. The other lot with one existing dwelling would need 0.50 acres and consists of 0.39 acres,
requiring a variance of 0.11 acres. Tax map 56A(1), section 1 parcel 24C has frontage on
Railroad Avenue (Rt. 788) and St. George Avenue (Rt. 1202). Located approximately 0.5 mile

DESCRIPTION OF REQUEST: Subdivide exsistinq property owned, left to both sons
at the death of both parents. Property purchased by Junie Conley. (father) in
1965. Three dwellings exist to the dream of Mr. Conley to have a home for his
wife and each son. Purchased in good faith that this would be done. Mrs. Conley
died Dec. 18, 1996, and Mr. Carroll Conley. (son) owns own property in Batesville.
Roy Conley, (son) wishes to purchase Carroll Conley's half of property for full
ownership. Roy Conley wishes to keep family home to preserve for his family
JUSTIFICATION SHALL BE BASED ON THESE THREE (3) CRITERIA:
1) That the strict application of this ordinance would produce
undue hardship.

At the time of purchase zoning didn't restrict the total dwellings nn a certain .
size lot. Zoning has changed over the years from 1965 since Mr_ Janie Conley's
purchase. If changed the property lines would measure with existing property
owned by others. This is the only property running from St_ C,enrcJe Ave_ to
Rail Road Ave.
3) That the authorization of such variance will not be of
substantial detriment to adjacent property and that the
character of the district will not be changed by the granting
of the variance.
The only effect that would take place to other property owners would be an in-
crease of value to existing properties. Each dwelling would remain the same,
and the look of the neighborhood would not change as it has since 1971. The sole
purpose is to meet the requirements of the financial institutions and meet the
legal zoning requirements from 1965 to present. A property line on paper is the
only effect.
The application may be deferred by the staff or the Board of
Zoning Appeals, if sufficient information necessary to this review
has not be submitted by the deadline.
