The Board ruled (2:2) to deny your variance request to reduce the front setback from 75 to 37 feet from Route 601 and the rear setback from 35 to 8 feet for the addition of a bathroom and classroom. Your options include: 1) If you are aggrieved by this decision, you have a right to appeal the notice within thirty days in accordance with Section 15.2-2314 of the State Code, or the decision shall be final and unappealable. Such appeal shall be taken within thirty days after the decision appealed from by filing with the Circuit Court of Albemarle County a notice of appeal specifying the grounds thereof. 2) Submit a building permit for the bathrooms only, with the structure (addition) located on the parking lot side of the church. 3) Wait 6 months and resubmit the same variance request. It is advisable that if you do this, you provide further justification for your request. 4) Revise your variance request such that it is not the same application heard by the Board of Zoning Appeals with VA-97-23. Letter to Owensville Pentecostal Church - VA-97-23 February 5, 1998 Page 2 5) Submit complete justification for building the bathroom only addition on the narrow portion of the lot. This justification is to address why it must be located on that side of the building instead of the other side. The justification cannot be just based on costs, but must be because of technical reasons. Please keep in mind that construction of bathroom facilities is allowed without a special permit; however, the location of those facilities must be approved. I have spoken with Mr. McCellan of the Thomas Jefferson Health Department. He has commented that in his opinion, there is no problem in locating the septic field on the side of the church where the main parking area is now located. He mentioned that it may be necessary to use a pump system in that location. He said that a pump system is usually better than a gravity system in that it allows the septic field to have a dosing and then rest, as opposed to a surging during peak uses. If you do not intend to proceed with the proposal shown with your variance, it is necessary for you to inform the Planning Department as soon as possible. They need to know if it should remain on the Planning Commission's schedule. Please consider your options and let us know what you choose to do. We look forward to working to resolve the issues.
