This is taller than the 12 foot height permitted.Where the sign will be located along the U.S. 29 right-of-way frontage) the base of the sign is 14 feet lower than the adjacent sidewalk and roadway. JUSTIFICATION SHALL BE BASED ON THESE THREE (3) CRITERIA: 1) That the strict application of this ordinance would produce undue hardship. Our hotel business will rely upon being visible from U_S_ 29 Strict application of the ordinance would not allow us to have a visible sign along the tt_S_ 29 right-of- way. A laismatlaltsign would be too short to be visible because of the steep slope and guardrail located above the sign. This would be very detrimental to our business 2) That such hardship is not shared generally by other properties in the same zoning district and the same vicinity. Our property is unique in that it is adjacent to U.S. 29, but it is at a much lower elevation than the roadway. Businesses on more level sites don't sharp our visibility problem. Applebee's has a similar hardship, but to a lesser degree_ Their signage problem was remedied by a variance allowing a taller sign_ 3) That the authorization of such variance will not be of substantial detriment to adjacent property and that the character of the district will not be changed by the granting of the variance. The allowance of additional sign height would not be detrimental to the district or adjacent properties. The net effect of the taller sign as viewed from U.S. 29 would be that our sign does not appear any taller than signs of other nearby businesses. The application may be deferred by the staff or the Board of I!! Zoning Appeals, if sufficient information necessary to this review has not be submitted by the deadline.
